Hi there thanks for this I will send it off. The thing I am worried about is that if the 20 year limit really starts to build up I will have missed out on a lot of money - can't think like that I know!

I'm not sure that you can revoke your statutory rights with the reply letter i.e even if you did send it they cant hold you to it.
Thus the small print on a lot of products "this does not affect your statutory rights"
Im sure someone can correct if me if I am wrong on this

Don't let RBOS get away with anyhing look at what profits they have just made!!! They do like to send letters saying you have not to tell anyone that they have settled and it is just a goodwill settlement. I never sign anything. If they don't send the money or credit an account then it is court as promised and they will have to pay up

This is true in essence however, i cant remeber where i saw it on this forum im sure though, that this may have changed.

I would therefore urge caution before singing Full and finalicon if it can be construed as applying to your relationship with the bank rather than on a per account basis.

it would be good to be wrong but im not sure i am.

Just spoke to RBOS myself and explained I was conserned to sign letter as I have other claims. They told me that a letter stating that I was only settling for this account only would be fine and they would pay out.

    Regards

    Henderson

For future reference when you settle with a bank you always tell them the settlement is conditional to receiving cleared funds/cheque within 7 days.

They may moan but its tough, they have shed loads of cash laying around if they really need it!!!

If it gets to court and the court don't specifically impose a timeframe for settlement, its usual for payments to be made within 14 days of the date of the order.

All i can say is that if you dont recevie the funds then write to them after seven days remidning them you expect it within seven days or you will file at court/continue with your claim and dont forget never stop the claim until you have cleared funds.
