    Default kerryanna V's Woolwich/Barclays

    Hi to those who were following on Delboy01's thread now I figured out how to do my own !!

    In brief Woolwich offered me 450 and then 550 against 1473 (1084 in charges the rest in interesticon I did give them a chance to settle for 75% at £ 813.00 but they ignored the proposal. I have sent a letter today refusing the second offer telling them they have until 07/03/07 to reimburse me in full otherwise I will take legal action. Going for the full monty guys. Suppose if your going to do a job its worth doing properly!

    No prbs Thailand.

    I cant recall the exact date I called Woolwich asking them for a statement of charges against my account for the the 6 yearsicon but I think it was around end of Jan beginning of Feb. They Sent me a full list and a letter offering an initial £ 450 (received on the 16th Feb), I replied by letter on the 21st saying I do not accpet and that I would accept and inculded the interesticon calculations Claiming for a total of £ 1473.00 but advising them that I would settle for £ 813.00, they ignored my proposal and then I got a letter on the 23rd Feb offering £550.00 for Full and finalicon settlement, stating that 'should I choose not to take this offer and start legal proceedings then it is clear we are unable to reach an amicable decision'. sent a refusal letter today as posted on delboys thread and now just to sit back and wait. I dont think they will increase their offer at this stage but am prepared now to see it through.

    Ok Kerry. What letter did you send (before today) was it a template? From this site or another?

    Did you just send a 'no' to thier first offer?

    Thank you for you letter dated 16/02/07 offering a settlement of £ 450.00 of which is not even equal to half of the amount and for which I am not happy to accept. I am writing to request that you repay all the default charges that have been applied to my account. I do not believe these charges reflect the true cost to Woolwich plc of going into unauthorised overdrafticon.

    The charges total £1084.00 plus as I believe I have been unlawfully deprived of the money I have calculated £388.01interest at the statutory rate, the amount the court will award.

    I therefore ask that you repay me the full amount of £ 1,472.01. I have attached a full schedule of the charges and interest with this document.

    I am fully aware of the volume of requests you may be receiving due to the recent publicity on such matters and do not wish to be awkward or prolong what could be a simple negotiation process therefore I propose that you offer me a refund of 75% for Full and finalicon settlement within a reasonable timescale of the charges excluding any interest which would amount to £813.00 which is equal to £ 659.01 less than the full amount with interest that I have claimed above.



    I look forward for a full response to this letter within 14 days.

    Firstly about the ERC PM. It is not recommended at this time to pursue this especially as you have too much on your plate with this claim, and you've alot of homework to do too...

    I will link you to the Zoots ERC thread shortly.

    Regarding this claim, I think of one thing you could do and then another one pops up to the contrary.

    I'm thinking start a fresh, or send in letter before actionicon citing they did not take you up on your offer therefore you have retracted it and are pursueing the claim in full, I don't know and hope someone comes up trumps for you.

    You haven't set any real deadlines and have been inconsistent with your requests. I am not being rude for a second, just trying to get my head around the possibilities.

    Thanks thailand that would be great new to all this as you can prob tell! hehe. With regards to the ERC its pretty non standard, I wanted to stay with the lender but there was a little unreasonable behaviour or at least thats how we interpreted it on their behalf. I'll post a thread and get some opinions or though have no intentions of biting off more than I can chew

    I respectfully decline your offer as Full and finalicon settlement and request, once again, that you return to me all charges imposed on this account, totalling £
    1,472.01.


    I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder, with a county courticon claim if necessary.

    My Request for Repayment letter dated 21/02/07 indicates that you have until 07/03/07 to respond before I proceed to the next stage . My deadline remains the same despite this offer.

    If you do not accept my conditions for acceptance, or you do not respond within 7 days, I shall proceed with my claim via the county courts. For the avoidance of doubt, I wish to stress that I do not accept your offer under the terms stated in your letter.

    My view (for what its worth! - I'm no lawyer!)

    Woolwich have stated that if you refuse the offer then it is clear you can not reach an amicable decision. They are aware you are willing to take them to court and acknowledge as much, therefore my view would be to go for the MCOL on 07/03/07. Thats the final deadline you have given them.

    Prelim sent 05/09/06, various correspondance sent/recieved, LBA sent 09/10/06, Goodwill gesture of £xxx offered 21/10/06 (rejected!), MCOL filed 11/12/06, Defence & Court AQ recieved 11/01/07 returned 29/01/07.
    30/01/07 Transferred to District Judge for directions. 05/04/07 Case Management Conference due at Southend County Court.

    I hope MCOL is cool too steve. I 've just noticed that the first letter Kerryanne sent was the 21st of Feb just 6 days ago, and another today.

    I don't want to further confuse anything but I'm now thinking, if we have to give them 28 days maybe it would be better to think of a date around 21st - 23rd March?

    Any thoughts?

    Hi Thailand,

    Sorry its been a bit quiet been away. I recieved a letter back from them yesterday saying that they are sorry but refuse to increase the offer from £ 550.00 and should I wish to settled to contact them wish i am not going to do. So I will wait until the 23rd and then what do i have to do then as I am away again next thurs until 22nd and wanna try and get everything prepared ready to go for when I get back.

    I would be tempted to send earlier, there is an argument that the bank has made its position clear so you have no choice. They 28 days is tried and tested though.
