I have issued a court claim against Natwest (22/02) and they had till 8th of March to reply. However, they sent me a letter yesterday (24/02) offering the charges I had been asking for of 1606 but as I had already issed the court claim should I keep going for the extra 500 in interest and court costs??
So basically unsure whether I should chase for the full amount (1606 + 8%) on the court forms or just accept the 1606. Tempted to accept the partial refund and chase for the rest now that I am out of pocket of 120 court fee.....
IMHO you have filed a claim at court so you reject the offer and carry on as normal, then next week you will probably get a cheque from cobbets for everything
Dear [named sender or Sirs]
Thank you for your letter dated xx/xx/xx. Prior to receipt of your letter I have filed a claim in the county court and have therefore incurred further costs.
I respectfully decline your offer of settlement and request, once again, that you return to me all charges imposed on this account, interest and court fees now totalling £xxxx
I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder.
I will be willing to withdraw my claim upon receipt of unconditional full settlement of my claim.
I trust this clarifies my position.
Did you issue on MCOL or in court. Either way, there is a good chance it hadn't been served before they made the offer.

I issed it in court last Fri, rec'd the letter from the court saying that they had served it 22/02 and then 24/02 I get this letter. So keep going you think???
i would keep going, and send a letter similar to the one i sent above, but its easy for me to say that now. When i had my offer, it took me 2 days to make my mind up,
but its your claim so its your call
If the claim had been served then yes, carry on and get your costs and interest back as well. A simple letter to Natwest pointing out that they were served on 22nd will probably do it.
