Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
About 10 months later (last October) I sold the car for £4300. I asked for a settlement figure from the finance company and they said £4k if you pay by Oct 28th (the day my regular payments went out). I sold the car around 10th October and paid the $4k.
I've just checked my bank statements and found they have took payments in OCt, Nov & Dec ! Not too sure about the Oct payment, but i@m pretty sure they owe me for Nov & DEc.
I need to draft a letter querying these payments, but not too sure how to word it. Any help would be appreciated
First, how did they take payments from your account - did you not cancel the direct debit or SO?
I would just write to them....
Dear Sirs,
Re: Account No: xxxxxx
This account was paid in full on the (insert date), but having checked my bank statements, I note that you continued to take payments from my account in (insert months).
Whilst I am sure this is no doubt an administrative error on your part, would you please ensure that these payments totalling £xxxx are returned to me within the next (7 - 14?) days.
