    Default barclaycard taking money from my bank account

    Hi

    I am new to this so please bear with me.

    I have an old debt with barclaycard, I have a bank account with Barclaysicon bank that only benefits are paid into.

    I received a letter yesterday morning dated 14th feb stating that barclaycard had taken £65.02 from my bank account for the outstanding debt I owed them.

    I checked my bank account this morning and they had helped themselves to another £168.00 on the 18th feb (I haven't yet received a letter from them to advise me they have done this).

    Our mortgageicon is due tomorrow and I will be unable to pay it because they have taken this money.

    I contacted barclaycard and they have requested I fax them a letter to prove that I have to pay my mortgageicon tomorrow and then they will consider refunding the £168.00 only, not until tuesday at the earliest.

    I'm worried as the mortgage is in my partners name although we live together and have two children that they will use this as an excuse not to refund me????

    I have swapped everything going in my barclays account to another bank account but one payment of carers allowance is due to go in monday so I'm hoping to write an appropriationicon letter to Barlcays bank to stop barclaycard taking this on monday!!

    Is there anything else I could do to get back the money they have already taken??

    i'm just worried that I have missed something.

    Any help would be greatly apreciated.

    Sorry probably wrong choice of a word when I said old, I've not paid anything since november 2005. Originally for £800 but now they want £1192.00. I'm happy to make an arrangement to pay it back but not the amount they are claiming I owe but thats a whole other ball game at the moment.

    I'm just shocked that they took £65 then four days later another £168!!!

    I'm thinking of faxing over proof of everything I have to pay next week (end of month bills - all priorities such as council tax, secured loan and mortgageicon all including arrears payments that must be met).

    I don't want to give them an excuse not to give me the money back and I'm really worried.

    Something very similar happened to me. Last September I was overpaidicon two payments by Family Tax Credits, one payment for £1500 and the other for £3500. The £3500 was returned to Family Tax Credit the same day, although it arrived in my account FTC managed to recall it. The other amount didn't. However Barclaycard managed to get £560 out of my account the same day. I am presuming my account was flagged (it is a Barclays account) It left my in debt with Family Tax Credit as the payment was an overpaymenticon and has to be paid back...... they are wonderful Barclaycard, dont' we love them.

    I won against MBNA, Nat West , Barclays, Barclaycard and PPI payments from Barclaycard
    Abbey National still to go.... what will I do with my spare time?

    Exactly the same thing happened to me with Lloydsicon 2 days ago. My working family taxcredit went in but I had three months arrears with my bank loan so LLoyds just took it. It was £945 and I wouldn't have minded but on the same day a LLoyds "councillor" was at my house refinancing my loan to lower payments! I rang the councillor later as soon as i saw what they had done and he was pretty disgusted with them.

    He's getting a manager to phone me back but still not heard anything. Surely just taking money (especially benefit money) without infoming me is no better than stealing?

    If you have debt with the same bank you bank with ( loan credit card, overdrafticon ) the bank has the first right of offset against funds paid in. They can and do take money to pay eg a credit card.

    You can exercise your forst right of appropriationicon over your funds but this should be in writing at least 7 days before the funds are due in.

    Best bet is to open a 'safe bank account ASAP ie one you don't have any debt with. Ask for a basic bank account; most high st banks offer these as well as the Post Office.

    Letter below for 1st right of app. but really moving banks is the best way to go

    You may also want to call National Debtline on 0808 808 4000 to get some free confidential independent advice - 'refinancing' is the banks way of making more dosh out of you - there may be other options you can look at depending on your circumstances
