Hi, I'm over the moon! HSBC just settled in full and now i'm ready to take them all on!! I was a bit sceptical whether this would all work but it just goes to show that NONE of this is legal! Anyways, the claim amount from Barclaycard will just be 140 pounds but it's enough!!!

I sent two data protection letters to Barclays and to Barclaycard on 12 June. They responded on 19 June with the (from what i've read) standard letter returning the 10 pound cheque and saying they will send the statements shortly. However, they don't actually refer to which account or which letter. It just says its from Peter Townsend, manager of data protection.
Soo.. i thought we were getting the statements shortly.
Then, yesterday, we received a letter from Barclays saying the outstanding balance on our Barclays account (197.97) was sold to 1st credit Limited and that all communications and payments should be addressed to 1st Credit Limited.
We are still interested in knowing how much we paid out in charges but does this mean we have to resend the letter to 1st Credit Limited? Or does the first letter we received refer to both accounts do you think?
And, does this mean it's too late to claim the charges back (if there are any?) And, we have been so angry with Barclaycard slapping on further charges, we haven't made a payment in a while, does this affect our chances of having the charges refunded?

Your account is clearly now in dispute, therefore they are not allowed to refer the account to a DCA.
If you read my thread http://www.consumeractiongroup.co.uk...-woolwich.html there is an excellent letter in there (post # 20) that rogerebaker posted (and I copied), my account has now been suspended with the DCA.
I would add a paragraph to this letter either reiterating the 40 day deadline or telling them you are sending a non compliance of the DPA letter. Bet your statements turn up then!!
Barclays has filed a defense...help needed please...
I'm now at the stage where Barclays have filed a defense and i've received the allocation questionnaire. Can someone tell me how to fill it out? Should i add anything to my claim in the section labelled "other information"?
Also, it gives the standard defense so should i include the spreadsheet with all the charges and just print it off? What about the fact that they have refunded half the amount that i filed for? SHould i include a letter stating this? And who do i send it to- the court?
Sorry for all the questions, i just want to make sure i do it right....

btw, i haven't read all the posts in the last few weeks, it looks as though one case almost went to court (Elliot) but was settled last minute... has Barclays actually taken the case all the way yet? Does anyone have any updates?
