Hi, i am claiming for a friends business account and have been trawling through the site for advice on the amount we can claim back. I notice some people have claimed more than £5k through the small claims courts. This is gonna be over £10k can we still go through small claims???? any advice would be great thanks

People haven't claimed more than £5k through SCC because SCC limit is £5k!! Claims are only over £5k when 8% interest has been added - the net claim needs to be less than £5k. HOWEVER no reason why you can't split the claim into to lumps of less than £5k (say split in to 2 three year periods for example) and still go through the small claims court. You are not exposed to their costs (should things go tits up) then.

Thanks T4FF, I 'm just a bit worried that might make things really confusing, as this will be the 1st time down that road if and when we get to court stage. The charges alone stand at over £14K. I'm not sure yet if the account owner is gonna go for contractual interest aswell. I will look at the totals tonight, if that's the case we might be filing 4 or more court claims!!! OMG

If you're claiming contractual, I would be advise to do a LOT of research on this site. I don't know whether it would be worth your while splitting it up that much........
