I need some help please. I am very confused and think i may have made errors. I am at the stage now where i have been issued with an allocation questionnaire.
I have just noticed to that in their defence they have stated that the charges which were applied, where applied prior to the 16 Janu 2001 and are not recoveable. My initial letter (repayment of charges) was dated 9 OCt 06 and charges went back to 11 Nov 00. Is this right? ~I thought because i started before the 6 year time limit this would be fine. To top it of i stated in the same letter that,
"I calculate that you have taken £xxxx. Total £xxxx with interest. If this matter is referred to court I will also be levying 8% on and from the date of the wrongful penalty charge, as is my right under British law."
I included i my spreadsheet all coloums including the last one interest 8% APR) was this wrong. I'm confused as to if i should have added this.
I have until the 5 March 07 to submit my allocation questionnaire but affraid i might lose and not sure what to do next.
I am claiming £4,762.91 and worried that i might lose it all if i dont get it right.
You started the claim for the money before the 6 years, they have dragged thier heels on it and therefore they hope you will drop those charges. They ARE still recoverable and they will not want to go to court and say they aren't. You could mention this in your aq if it worries you.
As for the 8%, you were correct to add this at the court stage, not before so chill out
