if you don't mind me asking, what was the argument put forward in the POC? mutuality & reciprocity? and was it interest NW had charged on the charges, or interest added to the claim in place of s.69 interest?

Brilliant answer to their defense. On their "Advice of debit interest for the period," which is an advice of their charges per quarter. It quite clearly states their "Current basis of interest calculation. " Borrowing upto overdraft limit 5.75% above base, and borrowing over overdraft limit (unauthorised ) 29.05% What i am trying to get at isthat you should be able to reclaim your contractual interest on your disputed charges,
because if their" penalty "charges are unenforcable, the interest attached to each charge must surely be refundable I hope that makes sense.
Your wording looks like a template in waiting to me! I believe that we should all be claiming contractual interest as a matter of course - NW paid 29.7% in my daughter's claim (settled in January). The wording I prepared for her wasn't anything like as comprehensive as yours though!
I'm going to c+p your words and save them in case any of the people I know currently claiming (1 friend + 3 work colleagues) need them.
It looks as if NW have retreated from the "not paying charges" position as untenable and have realised that their new "barricade" to defend is contractual interest. Their greed over the years could mean that they'll have to pay back a lot more than they've taken from us in the first place - boo hoo hoo!!
makes me feel a lot better about my case given Natwest said they'd settle less costs less (statutory) interest.
if they're settling contractual interest cases too makes me wish i'd charged that. guess its too late but still makes me feel more secure in my own case.
