Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I started reading all the posts on this site from middle of December, so i knew when i made my claim that it would probably reach the court stage, so i found it totally unbeliveable when after first letter they settled in full and money in my bank within days! I am still not sure why they have as quite a large amount and the usual pattern is that they dont, however it does show that sometimes it can be a very quick process. This is a brief summary of what happened. I sent of my data disclosure letter by recorded delivery on Dec 28th, i then received 6 yrs complete statements on Jan 18th. I sent of my 1st prelim letter with a spreadsheet of my charges and requesting £2,396.00 plus £724.00 in overdraft interest. Total £3,120.00. I sent this by recorded delivery on Jan 21st.I then received letter from Nat West dated Jan 31st saying how sorry they were that i was unhappy etc and then on next page the following "However, having reviewed your case and as a gesture of goodwill and without admission of liability or error, in this instance we are prepared to offer the amount of £3,120.00 paid direct to your account. To accept this offer in Full and final settlement of your complaint please let me know by completing the attached form and returning it to us in thr prepaid envelope provided." I sent form back the same day and money was paid into mt bank account three days later!!!!!!!! I did not get 8% as this is only added on at court stage, but cant think this is why they settled so quick. I am know trying to claim back from purple/ocwen/i group sevicing/ GE Loans, they keep changing their name. I sent of data letter same day as Nat West and they have ignored me so today sending of 7 day letter seeking Court action. I know this is probably the worst company on this site to deal with but i shall not give up!!
hi
Just wanted to say Congrats on getting all ur money back!
I hadn't even heard of this forum but my friend had been using it. She gave me the first template letter to claim the money back so I sent it, thinking I would have to go through the courts and they settled in full straight away!
I think Natwest are giving up the fight now, more and more people are getting all the money they have been charged back quite easily. Don't know why other banks don't follow suit!
