I dont know if anybody can help. I have an old car that I havent used for 18 months. I couldnt afford to fix it up and couldnt sell it either as the HP was still valid on it. I have kept it as SORN the whole time.
I have now sold the car and it is being picked up by the new owners today. But yesterday I received a £200 fixed penalty notice from the community wardens for abandoning a car. Now the car is parked in a residents only car park which is owned by a Housing Association (I am a tenant). They knew about the car and had wanted it moved. Once I had explained that I was getting it sorted they were really good about it and allowed me extra time to get it sorted.
Is this ticked valid considering that is was parked on private property, with the owners consent and was SORN the whole time? I am going to appeal it based on the above points. I didnt intend to leave it so long before sorting it out but as a single parent I couldnt afford it and I am so glad to be getting rid of the car at last.
I cant afford the £200 fine either, I am probably going end up in court for this. £200 in 14 days, yeah right
There is specific legislation that all Councils use re abandoned cars. One of the requirements is for a notice to have been adhered to the vehicle (normally for 28 days) if the owner was not known.
However, in your case, if you were still the registered owner, the should have written to you.
You need to write back to them and contest it (and the land owners of the car park could write a letter corroborating what you are claiming).
The other thing you could do is you onto their web-site and see what 'published' policy is in relation to abandoned cars. See if they have stuck to it in this case.
Just a quick update. Yesterday I spoke to somebody in the council about it and they didnt know anything about it. So I phoned the community warden who gave me the ticket and he just told me to appeal it.
Today I rang back the man at the council and he doesnt know anything about it. Normally anything like this would go to him and he doesnt know why. Even he has said that it was on private land with the owners consent so doesnt know why I got a ticket and they should have wrote to me or sent a letter which they didnt do. He is going to ring the warden and then ring me back. But I am still going to appeal it.
