I have just received a response from Lloyd after my first letter stating that they dont agree with the OFT's thinking on the issue and they are currently "talking it through with the" They ahve told me i can complain to the Financial Ombudsman Service if i like and also that they see their charges as 'fair'
I am just about to send lba to them saying that i will raise a court action so ill keep you all posted. One question i had though is if it does go to court what are the costs? Do i need a Solicitor?

You do not need a solicitor. The only costs you pay are the initial Court fee (how much it is depends on how much you are claiming) and the Allocation Questionnaire fee (again depends on how much your claim is for), the link below gives you more details: county court Fees

The time limit is up for the bank to reply so i want to go to the next step of court action, however they just did me for £70 for an unpaid DD!!!! Im furious as i dont have the money in my account to pay the initial court fees. Is it ok to wait until i get paid at the end of the month to start the proceedings?
Change of plan. I've done it online through MCOL now and its gone through today so lets see what happens! Agghhhh!! One thing though is i checked my form online and it said the court of Northampton??? I didn't put anything in relating to that court??? HELP!!

It always goes to Northampton Court, and then it's transferred to your local Court in a few weeks. You also need to send a copy of your latest schedule of charges to MCOL if you haven't already:
Send 2 copies of your schedule of charges, clearly marked with your claim no. + a brief covering letter asking for them to be filed with your claim to:

And when your claim is acknowledge by Lloyds, send a copy of your schedule to their Solicitors.
Im doing that now Barty but i have noticed that they have added more charges since i put in my claim. Do i send in the schedule with the new totals? or will this invalid my claim as my schedule differs from my claim form?

No stick to the amount that you have filed for, when they agree to settlement you can ask for the other charges to be added. To change the amount now would cost £35 (N244) which you can not claim. Or you can start a second claim on completion of this.
ok thanks. One thing i have just noticed. God im clumsy. The total i am claiming for on the claim form is £480 plus £50 court fee. In my particulars of my claim on the form i have not added it up correctly. What should i do? Claim for the total claim amount or whats in my particulars?
Thanks Barty. After reading more threads i know they are going to come back to me with 'your claim is too vague' emabarassing etc. Once i get this can i file an amendment? and how long do i have to do it?

Lloyds havent acknowledge as yet and i have read on other threads that they usually acknowledge within a week! What's anyone's position and thoughts as to applying for a judgment via default as soon as the 14 days is up? Or should i write to them giving them anothe 7 days?
