    Default Connaught Collections help needed

    In 2001 I took a loan with a company called The Associates , some time later I could not make the repayments due to having a baby and my circumstances changing. The staff at the branch of the Associates became abusive phoning me up saying I was an unfit mother, trying to pressurise me to keep up the payments . I disconnected my phone and to cut a long story a bit shorter heard no more from them till year 2006 , The Associates had been bought by Citi financial who in turn sold the debt to 1st crediticon who passed it to Connaught who sent their first letter threatening me with bancruptcy. I was distraught offered £20.00 per month which they would not accept after many calls they said the least they would accept per month was £90 per month which my father has had to pay on my behalf each month as I could not afford it . I have just come across this part of this site and we have been paying Connaught now £90.00 for about a year which none of us can afford and I have not even any idea of where the loan agreement is and no statement of how much more I owe etc, do you think i should start with a cca request to Connaught while continuing the payment for the time being?

    yes. send a CCA request (in library of forum) along with a £1 cheque or postal order. send recorded delivery. when it's delivered give them 12 working days to comply and if they haven't then you are within your rights to withhold payments until they comply. so if you're due to make a payment before the 12 working days then do so. after the 12 working days they have a further calendar month to comply and then not only is debt unenforceable but they have committed an offence. after this if they come up with agreement they need a court order to enforce. don't be fooled by copies of application forms or any other bluff

    thanks for this I am going to do this as I have no idea how they have arrived at the figure owed and my dad has paid them over £1000 in the last year as he was so worried they were threatening bancruptcy, which seemed quite extreme as I owe no money to any other company other than my mortgageicon, but just about scrape by each month. do you think I might be able to get my fathers money back from them if they can't come up with the signed agreement, has anyone been able to get the money back that they paid so far for this type of thing?

    Can I just ask a few questions, are you working at all ? You should only be paying what you yourself can afford as the debt is in your name. If you aren't working and are on benefits then you should only be paying a token payment of £1 a month. I know the letters can be very upsetting and quite scarey but it's important to know your rightsicon. The figure they set have nothing to do with your circumstances, they will try and get as much as they can. If you let us know a little bit more about your circumstances we could suggest a course of action.

    yes I am working full time , but have a mortgageicon that takes about 65-70% of my salary am locked into it for another 3 years I am single with one child and have also high childcare costs etc , do not have many other outgoings apart from utilities etc but am probably worse off than if I was on benefits , i.e. the amount of money I have left after bills , my father is paying them out of his savings he is a pensioner becuase if they threaten bancruptcy he does not want to see me homeless becuase of a realtively small unsecured loan from years ago, and I did not want to take the chance of them following their threat through. It would take another 2-3 year to clear this with them and we don't even know how they arrive at their figures but they are very nasty when you call them anyway.
