Hi all, I need some advice now.

Having already filed my court claim as RBSicon did not respond within my deadline I have now received a letter saying they have refunded £157 to my credit card.

I don't consider this to be satisfactory so I want to press on for the full amount. However, can I amend my court action to deduct the refunded amount or should I write to them asking them to cancel the refund as I am pursuing for the full amount?

    Any replies gratefully appreciated!

    No takers then?

I've sent them a letter today advising that I accept the £157 as part payment but that as they had not replied within my timescale I had already filed a court claim against them for the full amount plus interesticon and costs.

I hope this is the right course of action.

    Hi
I think that you have taken the correct action.

If you were to amend your Court details, then this would incur a non-refundable £35.00 and add a further delay to the proceedings.

    March 18th I believe.

I'm reluctant to ring them because I'd like everything to be documented really. I think I'll wait and hopefully win by default.

The fact that they've already refunded £157 complicates things a tad though. I really wanted to make it clear to them - in writing - that I do not consider the matter closed and want the full amount.

Not having actually done a small claimicon before (First Direct coughed £2160 on the first letter) I'm not sure whether I can deduct the £157 when I file for judgement on the 18th

EDIT: Having refunded it to my card, I'm sure they can just as easily have it back if the amount claimed on the judgement is not amendable.... i.e., they pay me the full amount and then take the £157 back off my card.

Heavy t, did you send the standard SARicon from here? I'm well clued up on claiming back from the banks, but I don't really know about credit cards. Is it the same process with the same letters etc???

Sorry for sounding thick, I've looked around the letter templates etc...I also want to go for store cards, any ideas??!

    Cheers

I just amended the SARicon to say "late payment fees" and "overlimit fees" rather than excess overdrafticon fees and obviously said "credit card account" rather than "bank account".

Other than that, exactly the same rules apply really.

I've just received a letter dated 8th March from them saying "thank you for your recent communication", rather than "your letter dated....." which seems a tad unprofessional as it doesn't really indicate which of my letters they are answering!

It says they are currently reviewing the issue and will contact me within two weeks to let me know how the issue is resolved/progressing.

This letter doesn't seem to be worth the paper it's written on.

Once again, sticking to MY schedule... which means they need to respond to the court claim by March14th.

They were all older ones for around £20 with the exception of a couple of newer £12 ones but I didn't bother claiming these. In hindsight I wonder if I should have...

    Success!!

Just received a cheque for the money plus costs and interest.... on my birthday too

Also had a standard letter saying if I incurred any more charges they would consider withdrawing my overdrafticon facility and only giving me a "basic bank account"..... interesting as I have a credit card with them NOT a bank account
