    I am negotiating this on behalf of my son. Free statements delivered in 5 days.The deadline for response to court order is this week. No response to initial letter until I sent a copy recorded. They have taken almost 3k in 4 years and I would be delighted to get it back for him.

    Good luck with yours and many thanks (whatever the outcome) to Dave & Co for the hours they must have put in to this.

    Received a notification letter today from the Customer Care Team.....

    First of all they were thanked me for my letter, and then advised me that they have also requested 6 yearsicon worth of statements and would contact me by the 18th May 2006 to provide me with either a full response or further update of my investigation.

    Received my second letter today.....

    "I am not yet in a position to respond to all your points in full because I am still awaiting duplicate statements on your account."

    "I am extremely sorry to have to keep you waiting, but rest assured, I will contact you again within the next two weeks."

    I take it I don't wait for them to respond, and send off the second letter letter before actionicon as the deadline is on the 21/05/06

    Received another letter today from the bank...

    "We believe that our charges are fair.... blah blah blah..."

    "However, we have taken the opportunity to review the charges applied to your account, and as an exceptional matter we are prepared to refund £245.00 as a gesture of goodwillicon.. blah blah blah."

    ".....and strictly on the basis that you agree not to disclose to any third party the fact, or any details relating to, this payment"


    "If you agree to accept my offer on this basis, please sign and return the copy of this letter...blah blah blah"


    Taken from 3.3 of the Step by Step Guide

    3.) you will be offered a partial refund (accept this but sign nothing - the money is yours - note we are not claiming for the extra interesticon incurred on overdrafts - this more than covers their costs, so don't start to feel sorry for them.) You will probably receive a letter offering a full refund next.


    How can I accept this offer without signing, as they state that I must sign the form to accep it ??
    An offer of £245 is a nice offer considering im completely skint at present but I'm still willing to go all the way, for the extra 2K!!!!


    I guess now I send the letter before actionicon .................

    That's right. They will cough up in the end.

    You could say in your lbaicon letter (which is what I did) that you accept their partial offer of £xx.xx on the understanding that if they don't pay the remaining amount by (the end of your LBA deadline) then you will pursue them for the balance through the small claims court.

    Expect them to then withdraw the offer and direct you to the Banking Ombudsmanicon

    It's your party - you set the rules. Go get em!

    Received a letter today advising that they are sticking to their guns, as the charges applied were due to a "lack of funds in the account" but their good will offer of £xxx.xx still stands.



    "I have alerted our lawyers and litigation department to your proposed action"

    Guess its time to fill out the money claim form ready for the 05/07/06.........

    good luck, I am going to request my statements tomorrow - can't wait I have been arguing with them for a while now about the way they charge. One operator's statement to me was and I quote: 'computers don't have any common sense' - that really says it all doesn't it. A question for anyone: If I have an overdrafticon with them which I am paying back at an agreed sum each month and they want to close the account if they demand the o/d back and I can't pay it what happens then?
