I sent my letter requesting return of my charges on the 13th dec 06, the BOS acknowleged the letter and stated they would have made a decision by the 14th Jan 07, two days before this date I received a letter stating they required more time and would have a decision to meby the 16th feb. Its the 13th today and I have still received no reply. I asked them to supply copies of all statements if they disagreed with the amount I had stated, I have received no correspondence re statements at all. I am not overly enthusiastic they will return the money for the 16th or will have made a decision. My friend who is with RBOS received hers within a week. Her bank manager advised her the banks were holding a meeting with the Ombudsman in feb, do you think they are holding off to try and avoid repaying me. If I receive another letter stating it will take longer what shall I do they have had over 9 weeks now.
It's really best to absolutely stick to the time-scales suggested on this site, and follow the step-by-step guide. After 40 days (+1) from your 1st letter BOS were in breach of the Data Protection Act. In the templates library there is a letter you can send to them for non-compliance. It's in the Data Protection section and it's template #3, I think. Don't forget it's YOUR claim, not theirs - you set the time scales, not them.

did you state in your letter about giving them 14 days notice before court action?
if you have, after that time is up you have to send them another letter (templates on the site) giving them a futher 14 days for them to comply.
I have just sent off my first letter asking for my refund and recieved a reply that they will be looking into my complaint and it would take them 4 weeks to do so. I am with Abbey, but as far as i know, all the banks do the same to try to stall you. you should ignore them when they say they need time, they have enough staff for this.
i will be sending my seconed letter off on tuesday, the 14 days will be up by then. most of the letters you recieve from your bank will be standard letters that go out to everyone, dont let it put you off.
you must tell them that you will take them to court, let them know you are serious and its on YOUR terms.
if you havnt already done so, read through threads that apply to you or your bank. i thought i knew quite a lot before i found this site, but really only knew bits.
the forums are really helpfull if you read them, they will give you encouragement and help for everything. Keep your own thread, it will help others as you go along.

sorry tookie - I misunderstood - I thought you meant you had sent your SAR in to them. No matter - just stick to your own timescale - don't let them stall you!
So should I write requesting my statements, in my original letter I did ask for these to be supplied if the figure I had given as not accurate. To be honest I think I underestimated the amount due back. When I was studying I had a disgusting amount of charges applied. Has anybody received charges back from BOS, without having to lodge court proceedings and how long did it take?
tookie - if this goes any further, you will need to give a detailed schedule of your charges, together with any interest you may decide to claim. It's as well you have this right at the beginning of the process. IMHO, I think that if you wrote to them with your "idea" of your charges and asking them to let you know if they were correct probably "flagged" up to them that you didn't really know what you were doing.
1. Are you certain of all your charges? Do you have copy statements, dates of charges, what the charges were for & if any interest has been charged on them? If you do, then,personally, I would start all over again with the preliminary letter
2. If you don't have all this information send off a S.A.R - (Subject access request) with the £10 fee.
Both these letters (and everything else you need) are in the templates library.
Once you have done either of these, stick rigidly to YOUR timescales. As I said before, it's YOUR claim. not theirs. Good luck and keep us posted on progress!
