    Wink Woodentop v Barclays **WON**

    Hi all, after reading so much info on here am now completely confused. Have received the last 6 yrsicon statements from Barclays (asked for them over the phone and received them within 2 weeks - no charge). I am about to send the preliminary letter and am I correct in thinking that I have to list everything on the spreadsheet (which I have downloaded) and send this with the letter minus the interesticon column.

    I know I am being dumb here, I know I can claim charges from Barclays that are listed as "Unauthorised O/D fee, Paid Referral, Unpaids" but do I claim the monthly "Interest Charges" they have put on the account as well. This is an Additions account so there is a monthly charge which has varied between £6.00 and £10.00 over the last 6 years so can't charge that back as we knew that the account carried a monthly charge.

    If I can claim all of the above I estimate the total owing to be in the regions of £3867 - this includes £892 of interest if I can charge that back as well.

    Your help would be appreciated - let battle commence.

    Yes you are correct in assuming that the spreadsheet (the schedule of Charges) should exclude the interest column

    Re the "Interest charges", you can claim these back if you can show that the penalty charges that were applied to your account put your account into overdrafticon, or increased an existing overdraft. If you already had an overdraft facility, then it can be tricky working out how much interest has been unlawfully charged, so most people dont bother, but there is a spreadsheet

    Thanks for prompt response.

    I am sure I will get the hang of this just a bit nervous first time - got plenty more to do after this one - thanks for help - will have a look at advanced spreadsheet but will probably not claim the interesticon charges.

    Ooh well plenty of work to keep me occupied on these cold evenings - will keep you informed or progress.

    If account is in joint names should both parties have signed the preliminary letter or just one if the account is either to sign?

    If you are both allowed to sign cheques and the like, then one signatureicon is sufficient.

    Just an update - Preliminary letter sent on 15 Feb - recorded delivery. No response as yet - the days are counting down. Do I count 14 days from 15 Feb i.e. 1st March is the date I issue the MCOL?

    Well an update - received letter dated 27 Feb from Barclaysicon from Neil Henderson at Freepost RLTA-CSUE-TCHE Head Office Customer Relations, London E14 - is that the normal address to get a response from??

    Anyway I presume its the normal fob off letter i.e. ... sorry i'm unhappy... my comments are receiving attention and one of his team will be contacting asap. Can he take the opportunity to explain that they will try to respond within timescale they cannot guarantee to... sometimes takes longer to investigate a complaint ... however they do aim to find a solution within 4 weeks.

    The above was followed by "A full report or an update on our progress will be sent to you within eight weeks". Are they contradicting themselves???
    They enclosed a leaflet for me to read on how they will deal with the matter and also gave phone number if i wish to discuss with them.

    Am I correct in thinking that I just carry on - i.e. on 14th day send the lbaicon to them - amended as I have received a response (as the template is as if no response has been received)? Would you send all letters to them Recorded Delivery or normal post now - the address at the top implies that their address is a freepost but I have never seen one with such a long address - what do you think peeps?

    This is still a little confusing to me - apologies for asking daft questions.

    Not sure about the address, when has a bank ever done anything for free?!! I would probably just send it recorded so you know its here and recieved.

    Oh and on my letter I put:

    I am very disappointed with your response dated 14th Feb which does not deal with my request for repayment of charges dated 8th feb within the time frame specified.
    I now understans that the regime of fees ETC..... and carried on with the orginal letter from templates.

    Just another thought in the letter from them it says if I want to discuss this further to call them - what do you think -is it too early to talk to them????

    Sorry to be a pain - just printed off another copy of Schedule and noticed that the interesticon figure has changed !!!!!! idiot that I am - do I put the new figure in the letter or leave it at the original figure that I put in first request letter. Promise I will get the hang of this - got loads to do (LOL)

    Don't phone them - just stick to sending letters!
    I'm not sure with the schedule of charges if you change it or keep it the same,I kept mine the same but when it comes to MCOL I will show the revised price as they will then know the amount it will go up each day until they pay.

    Panic mode now - Barclaysicon converted overdrafticon into a loan few months ago so now have no O/D - paying this back over 2 yrs. My question is can they demand that we pay this loan off out of the charges I am reclaiming.
