Need help if possible - sent SAR to Egg on the 9th Jan, they signed for it on the 15th. On the 7th Feb received letter stating they cannot share the info without proof of id and that the 40 days will start from when they receive the proof of id. Surely this is not right, has anyone else had this and what should I do?

You have failed to comply with my Data Protection Act Subject access request dated 9th January, 2007.
If you do not comply within the next 7 days I shall seek a Court Order obliging you to do so together with damages at the discretion of the Court and without any further notice.

I did send proof of ID on the 9/02/07 and I then received that proof back from Egg about a week later but I have not heard anything since. I then sent then the failure to comply letter on the 20th Feb giving them 7 days to comply within 7 days but still nothing. Any advice as to what I do next would be appreciated.

If they received it on 10FEB, then they will regard 22MAR as their deadline for compliance. I believe most claimants do receive their statements (a pile of paper one inch thick) within 20 to 30 days rather than 40.
When you receive statements ensure that no pages recording unlawful charges are accidentally missed out. Good luck!

Thanks for the advice Mistermind. Just aware that I gave them 7 days to provide this information on the 20th Feb and this has now passed. So am now thinking need to let them know I mean business and file at court for non-compliance - bearing in mind the initial letter was sent on the 9th Jan.

I can understand your point and frustration but imho you should keep these aces tucked away up your sleeve in case you ever get to court. They will be far more effective at that stage...

Thanks Zubo - I see where you are coming from in that I have given then every opportunity to comply etc? Will wait a while longer - am pretty busy anyway with others! Gives me more time to focus properly as I don't want to make any mistakes that they could trip me up on!

Have been quite busy - so just got round to looking at the statements tonight. It appears that I only have £100 to claim on this one.:-| Anyhow will go ahead and send off letter for repayment of charges and see what the outcome is.
