    Default Help Required Please = BarclayCard = Old Bill & Halifax

    Hi all

    This is my first problem i've had for many years and I don't know where I stand, If anyone could help me to get the right advice I would be truely gratefull. Here we go this is my problem;

    12 years ago I had a barclaycard when I was young and always buying stuff left right and centre, now I paid the bills bit by bit and eventually thought i'd paid if off as no more monthly bills were sent out. I moved home in Oct 95 and I didn't bother informing them as I had no letters off them for a few months, now today I got a letter from some credit recovery place demanding I pay £3,172.93 within 7 days I didn't know who they were so I phoned them and asked who they were and what the debt was and they explained they were collecting on behalf of Barclaycard now my limit on my Barclaycard was only £1000 so I thought it was paid off, now they say its for charges and interesticon owed. I thinks a bit steep but I don't know the law so I haven't a clue what to do now I'm disabled and don't earn that much money and I have a family to support what should I do. I thought after this amount of time 12 years they would of claimed any loss on there insurance but as I wasn't aware of any amount left owing how could I know. Please could anyone please give me any advice on what to do. Thank you all in advance for any help in this matter.

    If the last contact you had with them was in 1995, then the debt is certainly statute-barred - all consumer debts are if no contact has been made for six years or more. Don't call them again, as they may try and claim that you 'restarted the clock' with your phone callicon. You won't have, it's a line they use as acknowledgement has to be in writing, but it complicates things when really all you need to do is send this letter here:

    Insert the line 'I do not acknowledge any debt to your company' in between the 'Dear' and the first line, and you're set! They cannot legally pursue you if you have had no contact with them for six years or more.

    May I ask if this company was ECI? i have had them chase me for an old barclaycard which i am sure I have paid off (I owe enough people money to know who I owe) and I advised them it was statute barredicon, no joy, so emailed scott soutar, their MD and was advised no further action.

    All help is merely my opinion only - please seek legal advice if you need to as I am only qualified in SEN law.

    Well I have had no reply since writing the letter to these people but now I have received another debt from another company Thames Credit services stating I owe them from 1997, I have sent them a similar letter and they have replied saying that this statute does not affect there claim is this right or are they just trying to get me to pay as they have bought the debt off Halifaxicon Bank. All I need to know is are they right about the statute-barred not affecting this. Thank you in advance for any help.

    They have also said they would reduce the debt by 50% if I pay by the 20/08/2007 is this just another con to get me to pay or not. I have not had any contact from Halifax since 1997 so what do I do?

    Yup. The first firm has sold the debt on to another firm and they'll try to get the money as best they can. If you've not responded, don't. They would be hard pressed to take you to court for this, but they may tire of pursuing you if they don't get a response to letters or phone callsicon.

    I have only sent them the first letter about the statute barredicon saying I do not acknowledge the debt. Are you saying not to respond to them anymore?

    Once you've told them it's statute-barred, you don't have to do a thing. The 'reduced offer' is to their way of thinking: "We're never going to get the full amount 'cos we can't take him to court - let's offer a half settlement 'cos he's more likely to pay if he thinks it's a reduction..."
