Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
My fourth claim, the first of which is on a Credit Card. After successes with HSBC, Natwest & Alliance & Leicester, I'm hot on the tail of Barclaycard!
Anyway, I've successfully obtained all previous statements (up to May 2001, however there is still a balance on the account at that time!). I'll be writing to ask what on earths happened to the missing previous statements, and if they can't provide them I'll probably get peoples opinions on claiming back the balance at that time ontop of the unfair charges.
Anyway, total charges dated from May 2001 = £550.
I intending to calculate the interest I have paid on these charges with a handy spreadsheet I found somewhere on the forum, plus I'll also be claiming back the compounded contractual rate of interest (at the current unarranged borrowing rate that Barclaycard charge, which I believe is quite high...!)
I can't seem to find a contractual interest calculator spreadsheet on the forum for Credit Cards, does anybody have a link to one handy?
I'm expecting a bumpy ride, but I have my flak jacket on and I'm going in...
I've found Vamps credit card calculating sheet, I think I've got the jist of how to work it!
Anyway, Just a couple of questions if anybody could lend me their opinion:
The current APR for the Barclaycard Initial card is 27.9% APR. Is this the correct rate to use for in my contractual interest claim?
Partial Refunds - can I refuse to accept any partial refunds? I understand I can accept it not on the grounds that it is taken as full payment and persue the rest however I realise that causes problems of people not wanting to take them to court just to recover the contractual interest etc (it also increases the money owed due to interest if I'm entirely honest!)
Turns out my £550 penalty charges claim after adding 27.9% contractual interest and claiming back the interest charged on those penalties adds up to around £2100...
Just wish I'd have known about adding contractual interest when doing my alliance & leicester claim for £1700 worth of charges!
