I SAR Barclaycard and they have now sold the debt without responding. The DCA has phoned me and when I get the letter I will CCA them, but can Barclaycard do this without responding and do they still have to respond. I want to claim back charges and a mis-sold PPI so do I still deal directly with Barclaycard ?. Thanks for looking.
Kane, Barclaycard have 40 days in which to respond to your request. If that
time has not yet expired, you can write to them pointing out that they still
have to fulfill the SAR requirements. In addition, it was the duty of BC to write
and inform you of the assignment of the debt.
If the time has expired, give them seven days to comply or you will make out a complaint to the ICO.
If the DCA do not accept that you are in dispute with BC, send them a CCA request which will stop them in their tracks until they can produce the
required documentation.
