Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
My freind,, who is a single mother of 3 kids and skint, has been impressed at my sucess with a win against Halifax . She has no access to the internet, so I have been helping her.
I printed a copy of the SAR and she filled in the personal detail and hand wote it, she took it to the local branch with £10.00. I told her to get receipts for both. The staff called the Manager, who said, there was no need for all this, and he would sort it all out for her, he did not take the £10.00 and did not take the letter! she has now been contacted and asked to come in and see the manager as he has had a chance to look at the 3 years worth of statements (?8-) ) funny I thought we asked for 6 as per usual! I am beguining to smell a rat here! Although my friend is impressed with all the attention she is getting.
Is a new tactic to be totally charming and then to make the customer feel happy to have been 'given' all the charges back - infact ony 1/2 back??-
She has asked me to go along to support her, my advice to her is to have all of the money back - all 6 years of it, and make decisions only having had a chance to study the statements herself. Although if he does pay up all 3 years worth , she can always go after the other 3 aswell!
I would also reccomend going along as well, maybe it's a good idea to take a print out of the whole procedure and show the "manager" that it would be in their best interest to refund the whole 6 years as the interest that would build up over the months that it would take before a court date would save the bank a penny or two !
That is a god idea - didn't think of that one! Like you say , he probably willbe thinking he is saving him self hassel his way, But the interest she would get onthe 3 earlier years looks like it would be well worth mentioning!! Well done.
Well my friend has now informed me that the manager has given her the 3 yrs worth of statements - he rang and told her he had spent the whole weekend looking them up for her? (wot!) anyhow he didn't speak to her when she went in . she was just given her 3 yrs of statements...glad I didn't go along (but wasn't asked to as I would have done), I think she thought he was gonna say , ok mrs ****** here is you £++++++ and have a nice day! oh and we will sort out the other 3 years later!
Another smelly rat - just another obsticle in the path..we will step ever and maybe this time she will send off the SAR as I first advised!!
Well - freind came round yesterday and we have just done the SAR (again ) and this time it is being posted - recorded of course - and postal order sent with it. in the two years and 2 months worth of statements the manager gave her there are £3.5k worth of charges, so this is gonna be a biggie...think she will have to split it as she cannot afford to go anything but small claim.
we will start at the oldest ones and do 5K at a time , waiting for each one to finish befor starting another...she is aware not to agree to any terms and conditions, contrary to this
Also the terrible thing is she and the 3 kids have been given notice of eviction for a few hundred quid arrears...These banks have alot to answer for...she has all the bills on DD and SO and the banks are just helping themselves ever month an charges, I dunno these banks do need to be stopped.
Please can this thread be moved onto the Nat West site!! She has just given me her statements and I have realised I am doing the paper work for Nat West - Not Barclays!! (silly me )

Time has just flown by- and my friend has told me today that she has accepted an offer made to her for over 4K - We were just about to put the case into the courts - they have offered her just about all we were claiming for.....And she is in such a position in life that she cannot afford to turn away the offer - She hasnt told me exactly how much they have offered but she said it was "about the right amount" Not ideal - but one more happy customer!!
She has not given a donation to the site (or me!)- I am sorry, I shall ask again for a small contribution!!!!
