    Default RBS now defending - any advice

    I have been reading through your posts for a while now, I wrote to RBSicon at the end of October requesting statements for two accounts and sent them two £10 cheques, they delayed sending statements by kindly informing me that they only charge £5 for both sets so could I send a new cheque!! Eventually I got them and worked out amounts owed to us which total £6684 without even looking at interesticon.

    I then wrote your standard template letter to them requesting a return of all charges within seven days or further action would be taken. This was sent mid December.

    I heard nothing for way over seven days so I took them to court on two separate claims, one for single account and one for joint so they were under £5K each. These claims were entered on different days too, the 5th and 8th January. I then received a letter from their head office appologising for the delay in a response but that they were now looking into it - too late!

    They acknowledged both claims within the 14 days of claim, stating they would be defending and today (7th Feb) have put in a defence on MCOL for the later claim but do not seem to have done anything on the first one which I think I can request judgement on tomorrow although I am sure that they will be putting in a defence on that too.

    It just seems odd to me that they defend some claims and not others, some people seem to have been paid similar amounts to mine from a letter alone, others have taken court action and then been paid before it got this far, yet they are defending my claim?

    I will return the defence forms as soon as I receive them of course but how much longer do you think they will drag this out?

    Are they likely to actually go to court and if so will this really take up to four months? Or is it more likey they will cave in before then?

    Any help or assistance would be most welcome. I am getting more and more fed up with the waiting and uncertanty now! Especially as someone told me the law is changing in March and we might not be entitled to our money back anymore???

    I have received two letters from Cobbetts in the last two days, both to confirm their supply of their aqicon to the court for the claims I have made on our joint and my sole account.

    However on the one received today (joint account), it had this written on it under Other Information:

    "This claim has now settled and the Defendant expects the Claimant to be writing to the Court with a Notice of Discontinuation in the near future."

    I have heard nothing from anyone about settlement of my claim and the other claim for my sole account did not have this written on the AQ under Other Information?

    Should I contact Cobbetts or just sit tight now and wait for an offer letter or the full payment?

    Any help or assistance gratefully received.

    Ok, first of all you must expect a defence. It is perfectly normal and nothing to be concerned about.

    With regard to the notice from Cobbetts that one claim is settled, unless you have received full payment, including court fees and any interesticon owed then it is not settled. I would be inclined to write back to Cobbetts and ask them precisely how this claim is settled as, to date, you have not receieved any money.

    Is it possible that RBSicon have made a payment into your account? Or maybe a cheque has been sent but this correspondence has arrived first?

    Finally, in reference to your first post regarding a law change in March, please read here to set your mind at rest.
