    Default Lots of Nerves, need help !

    Hi all
    I have been using this site after recommendation from friends, I'm a bit poor and seemed like a silver lining back in July 06.
    I haven't exactly recorded dates of letters I sent in the begining or copies for that matter, (bit shoddy I know). This is prooving difficult now as I have a court date set on 22nd Feb 07 and have to supply a witness statement. (I'm asking for £900 odd they've paid staright out for higher claims)
    I am very grateful for the help on this site. I have now got an idea of what to do but it seems I have to by pass specific dates.
    Will this be held against me?
    Do you think Lloydsicon TSB will go all the way?
    They did postpone the court date saying they would like to discuss settlement out of court, this was back in September but I haven't heard anything???
    Lots of questions, lots of nerves, can anyone help ???

    You need to post (in full) the last order you received from the courts, it should include the trial date and the documents you are required to provide prior to the trial, amongst other things.

    It is likely you will have to file a bundle (basically the documents you are relying on) 14 days prior to the 22 February 2007, so you need to be quick.

    Likely that Lloydsicon will settle prior to the hearing date, but you must prepare like they will not.

    Thankyou so much for taking the time to reply!

    The last letter received was:

    District Judge Carr has considered the statements of this case and allocation questionnaires filed and allocated the small claims track.

    The hearing of the claim will take place at 10:00 on the 22nd Feb 07 at county courticon + address

    The court must be informed immediately if the case is settled by agreement before the hearing daye.

    Each party shall deliver to every other party and to the court office copies of all documents on which he intends to rely at the hearing no later than 14 days before the hearing.

    The original documents shall be brought to the hearing.

    Witness statements (including those of parties themselves) must be included in the documents filed and served.

    A party failing to comply with this direction will not be able to call/give that evidence without permission of the judge hearing the case.


    What do you think?
    I have got an idea for a witness statement thankyou to other members which I will send first class tomorrow.
    I cannot attend so I will write and opologise too, do you think this will affect my claim?

    Can you post up the contents of your particulars of claim please.

    If you have used the POCicon from this site then you need to follow the instructions and submit the documents soonest to comply with the 14 day deadline as below:

    You really need to attend court.

    Are you sure you are okay with the witness statement? You should send this with the bundle.

    I should tell you that it is unlikely that Lloydsicon will serve a bundle or attend court.

    Can you point out what is the 'witness statement?' I've got the basic bundle, and have got the other evidence provided by this site, but I'm wondering what the witness statement is?

    I've been sent to Fast Track, but I imagine the documents thing is just the same. I've started another thread asking.
