Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
i think this is how it works. a Subject access request is for data held by a company about you and you are entitled to all this information for a small fee not exceeding £10. the trust deed should not stop you from getting information about you from any company.
i would check with the people that hold the trust deed what the implications are if i were to claim this money back from the bank. also how long is the trust deed to run. this can all be checked before step 2. also if the trust deed is to run for say another year then personally i would wait till it was finished then claim this would then mean i get all the money?
Is there no time scale for claiming back from the bank?
Trust deed finishes next june but i would wait until it finishes. I will ask the trustdeed holders for info though.
there is a time limit you can only claim back 6 years in england and only 5 years in scotland. i am claiming back 6 years even though i am in scotland and i will chance my arm at getting it all.
ps i do however have a sister in england where i can get mail directed and also allow me to use the online mcol {online court system} but need address in england to use it.
