Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I got an FPN for illigal parking and i asked them if i could pay the ticket of in installments as im not working and on benefits, they said i couldn't.
The FPN sent me to court on thursday and the courts have added 50% on the ticket which i told them that i didn't refused to pay,its because im on benefits i couldn't pay it off all at once, now the courts are going to add 50% to the ticket and take it off my benefit.
I have proof of asking the FPN office to pay in installments so can the FPN send me to court and the courts add 50% on the ticket for "NOT" refusing to pay the FPN?
Its going to take longer to pay off this ticket if the courts get away with adding 50% on the FPN...also,when i ask the FPN office if i can pay in installments they said i couldn't,then all of a sudden,go to court, add 50% on ticket and a presto installments.
Please can any1 help me.
1) Pay the amount demanded and this will be an end to the matter
2) Write to the issing authority and request a court hearing. The FPN will be cancelled and you will be summonsed to court for the case to be heard by Magistrates. They will decide guilt (and sentence and costs).
3) Do nothing. The law then allows them to add the extra charge as the fine is unpaid after X days and then pursue the fine as though it were issued by the Magistrates. This means Court baliffs and at the extreme jail for non-payment.
They cannot accept payment of an FPN by instalments. Once the matter is a court fine (or appears as one) then an instalment plan can be arranged
