Hi everyone an interesting thing happened on the way to the court!
Two accounts with GM Card, charges of £90 and £355 over the last 6 years. Not much but its the principle. Two weeks after lba offer in settlement of charges . Wrote back no; by return charges + s69, but not contractual, interest in settlement!
Accepted this as difference not great and have bigger fish [Nat West Bank charges and Lloyds PPI ] to fry. Also I am mindful of the test of reasonableness. I guess they could counterclaim for their actual costs which would be somewhere around the difference between s69 and contractual!
I think they are on the run!
Has anyone else had an offer to settle for s69 but not contractual?
