Thread: default on loan

    Default default on loan

    I have challenged my bank, Abbeyicon, regarding my bank charges, and have a court date in March.

    I also have a loan with Abbey, which has now been placed with a DCAicon and a default place on my account. I asked Abbey to delay this as my claim against them is £2000 (on the bank account), and my arrears with them was £1000 (on the loan). I even offered to ofset the difference and only claim £1000. They said NO.

    Can I challenge the default that has been placed on my credit file, and if so how?

    I have always maintained with Abbey that they owe me more than I owe them, and that the bank account and loan departments come under the same 'Abbey' brand name, therefore the default should be null and void.

    Any advice/suggestions would be gratefully recieved. I have looked through other posts and cannot find a similar theme, and there is nothing in the templates section for chalenging a default under these conditions.

    I take it from your post that the loan is a seperate account from the one you are claiming charges back on. If that is the case and you hadn't kept up payments on your loan then what they have done is correct. You had defaulted on the loan and they have recorded it so. If you were going after unlawful charges on the loan account it would be a different matter!

    Thanks Pam, I assumed this was the case., Abbeyicon are, however, very image aware, with everything coming under the same brand name. Current accounts, savings, loans and mortgages are all branded simply as 'Abbey', with only credit cards being a seperate entity, having been passed to MBNAicon.
    There is nothing in their stationery to to distinguise between department, and even the same person writes to me about both accounts ( bank account and loan letters signed by Allen Betts), so it's obvios that Abbey passes information between departments. I also believe ALL complaints are handled by one specific department covering all of Abbey. Is it not justified therefore, for the consumer to class 'Abbey' as one entity regardless of the specifics of the complaint/enquirey

    Has anyone tested this ruling, or am I going down a dead end with this one. Perhaps is this just an example of Abbey rage that I need to let go.
