    Default Is it worth persuing

    I am in court fighting to see my daughter. My ex was not turning up for court and in the end the we had to make a decision and apply to have a court bailifficon sit outside the house and serve her in person.

    My legal aid did not cover this so had to apply for a extension. If I get refused my case will fall over and die and it will be a long time before I see my daughter.

    If this happens would it be worth go to another solicitor and starting again?

    I dont want to wait 14 years for her to come find me

    Here is the story anyway.

    Usual crap we split up and she uses my daughter to get to me. She gets remarried and her husband is a retard who drinks alot.

    December 2004 just two weeks before Christmas she stops me seeing her. Since I had no court order backing me up I had to go the long way around. Now since Dec 04 and now there have been 8 court dates and she has turned up to one case.

    As the court cannot prove she got the papers they sent a bailifficon around to her house to hand her the papers. At first she said she was my ex's sister but she don't have one. After I told them that they went again and now she refuses to answer the door. So we need to get a court bailifficon to serve her the papers in her hand but we need one to wait outside her house. This is what I am asking for.

    Also in 2005 her husband came to my house drunk and pushed pass my gf to get in the house. He wanted to fight me. In the end we had him arrested for burglary. He was bailed to never approach us.

    Any advice please?

    It is definitely worth pursuing. You should not be denied access to your daughter.
    But I think that you will need professional legal help to get access. I don't really think that I can suggest anything else.

    Harsh maybe but true. Too many solicitoirs around charging fortunes for little more than asking their secretaries to type out a few letters and a lot of bills rather than actually FIGHTING your case for you.

    Yet another UKplc disgrace. Never forget you are paying your solicitor to FIGHT your case, get on HIS case and get him to earn his not insignificant but all-too-often undeserved salary.

    I only mouth my opinion, please look elsewhere for sensible advice!
