Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I have just asked my bank for a list of bank charges over the last 6 years and they have clearly stated that if I pursue this they will close my account and i'll not be able to open a bank account anywhere else.
They can close your account which is why it is recommended by the site to open an account with another bank not connected to HBOS. Welcome to the CAG family

My wife also has a seperate account with the Bank of Scotland, will they close that too (have £3000 overdraft and can't afford to pay back instantly)?
Or will they accept a repayment schedule? any thoughts?
Do all banks threaten this because this is the only thing that puts me off I don't have an income other than incapacity benefit and tax credits so am unable to open an account with any bank other than Barclays with whom I have banked with for over 12 years but Im sick of the charges.
KAIZER ... surprised at your comment. I am sure you can open an account at a bank to suit yourself. You may need to put a few £'s in to open matters ... but then you just advise the benefit and tax credit offices of your change of bank details and payments go in to your new bank account.

My BOS account overdraft £100
My wife's account overdraft £3,200
My wife's BoS credit card £8,000
If i pursue bank charges and they close accounts, we cannot afford £11,300 to pay them back immediately.
I thought that we could ask for details of charges going back x years and then make a decision wether to proceed, however, it appears people have had there bank accounts closed at this early stage of just requesting the information.
Please give me some good advice, we can not be the only ones in this situation and I do not want the BoS to defeat us.
When I heard of this bank tactic, I added into my into one of my letters that any attempt to close my account would be meet with legal action.
I am at the MCOL stage and so far they have not said that they will but I am still waiting!

I'm surprised at this - have you claimed charges from them before ? Can you give us more details of their letter ?
Cheers
I have never taken action against them for bank charges.
I had a verbal discussion with a customer service supervisor whom stated that if I proceeded to ask for bank charges back, or details of historic bank charged - I would see my account closed!
Can they lawfully close my accounts? Can they demand all their money back without offering the option to pay it back in installments?
Is this all just threats to put me off claiming back bank charges?

What would you base your legal action on? - i'm sure in their T&Cs they have the right to close anyones account for no reason!
Is it just part of the process that you get you account shut-down or does this not happen very often. Have you been in debt with the bank when your account has been closed?, what happened?
My understanding is that they wont close your account unless you claim for charges a second time - sounds like an over zealous call centre space cadet. Re legal action there are a few threads about how you can complain to the banking Ombudsman if the are deemed to be taking retalitory action to your claim.
Definately open another current account with a different bank just now (incase they close your account....it has happened).
The bank cannot close your wifes accounts as they are in her name and not yours.
I seriously doubt that the views of this customer service person is the last word of the bank, many people have succeeded in claiming and have kept their accounts open. Read a lot of threads on here and you'll hear the same threats re-iterated by lots of banks.
Go for it...theres lots of advice and help available on here.....remember its you who is the customer not them......so if need be vote with your feet and once you've successfully reclaimed YOUR money, close your account with them.
chin up, you'll get there.

The majority of my bank charges are for Barclays honering cheques etc due to CSA not paying the money in on time due to computer errors(CSA still say that I should not ask them to refund charges) so my bank records look like I am continually going overdrawn so no other bank would accept me to open another account due to credit scores so what option do I have but to accept the charges and do nothing!
hiya all
I am trying to recover 350.00 charges from one account, virgin, part of RBS. I have complained to them by email and phone and now they have sent me a letter advising their terms and conditions, plus a line highlighted that my account performance will be given to the credit agencies.
My question also to you guys is ,as given by all from advice from this site, i have already set up another bank account my ddi sta and saleries are in the new account, but i had asked one account to advise me of what their actual costs are for the charges not 29.00 each one to let me know my dd had failed. I even advised them on the phone i was happy to pay some payment but not the 29.00 on some days 3 times. I have a debit balance of 255.00 - do i pay this back to them as i feel under durress to do, to protect my credit file. Or do i persue the first letter for the 6 yrs statements and any manual intervention? Then write the next letter advising my request for refund of charges? By the way did any one read daily mail saturday last, a customer rbs went in with the bailiffs, and got his money back.
Hi Kaizer
I 2 only get incap and wtc yes the bank could close your account Lloyds threatend me with this but didn't carry it out as i think they realised if they did they would be 18k down and unable to get it back
anyway you can open a basic account with other banks (in theary the bank cannot stop you opening a new account with another bank)i got the info from citizens advice . you could change your accounts to basic or
get intouch with incap benifit and they can arrange a post office account to pay your benifit in you can also pay wtc in as well (you cannot pay out dd or s- orders you can only withdraw cash ) if you decide to claim you can get help with court fees . i also got info and help from the consumer credit counciling service (they have a web site )
any way good luck with what ever you decide
if i can help any more just shout
Dave
Please be aware that the welcome forum is for an introduction to the site.
Claims should be dealt with on threads, I shall get your thread moved to the RBS forum.
Yes long overdue.
Just one point......Is your user name here also your real name ?
The banks are actively monitoring this site so if this IS the case.....then you should pm admin for a username change.
