Hi Bulldog, remember that they have 40 days to comply and will probably comply just within that time. I know they have an awful lot of SAR's to deal with so you are probably just in the queue! If they fail to comply within the 40 days, report them to the Information Commissioner but I suspect that won't be necessary!

Hi Bulldog, I would ring them up on Monday and tell them you are reporting them to the Information Commissioner for non-compliance and do it too. There is a form on the Information Commissioner's website.
You can threaten them with court too.
Tell them you want the statements within 7 days.
They have got a bloody cheek.

Morning Bulldog, I would address it to Michael Rhodes who is the head of the CEO's. When I have copied him in on letters or emails, I have always had a faster response.

How about filing in N1 cost £50.00 for non-compliance and get it served without fooling around any more with them. I have found the only way is dierect action. Also fill in the Information Commissioners office on line .
Don't be surpirsed to find a special delivery letter from them within a week and the post mark will be the 47th day.
AZt leat you will get back you filing fee and the include the cost of the SAR and postage in your POC on the N1
Might I suggest you read up on the FAQ's so you can get an idea of what to do.
An N1 is the documentation you file in the Smalls Claim Court, you put in your Points of Claim (POC) and it will cost £50.00 filing fee. This is of course if you decide to go MBNA for non-compliance of your DPA SAR. The Judge will order them to havd over the documentation you have requested and fine them for not complying with your request.
If it has been passed for to a DCA for collection, I would qwrite to the DCA and inform that the account is in dispute and while it is in dispute they are not to contact you. This is why it is so important to read up while waiting for your documentation

a quick look through and there is £1705.00 overlimit charges and late fee charges.are these what i am reclaiming,and what about the contracual interest.what is the percentage for that.

Hi Bulldog, yes these are what you are reclaiming. Re : contractual interest, you need to check your statement to see what they are currently charging you.

If you go onto |MBNA's web site you will find the rate of interest on there when I started my claim it was 24.09% contractual interest and that is the rate you claim back
