I successfully challenged BOS last year an reclaimed £1200 in charges.
Following this my partner decided to challenge his by a rather unorthodox manner... he moved bank account, leaving an overdraft equivalent to the charges by Clydesdale bank. Now the bank is taking him to court. Can his defence be unlawful bank charges and if so does he simply quote the same OFT advice etc as I did with my claim against BOS?

OK, can't be of any real help - this is more advanced than I thought. I am now, in all honesty, guessing. However my gut feeling would be to attend and ask for more time (using the bank charges as an excuse, and playing it thick - should it come to that) I really shouldn't be posting this but any opinion is better than none, I guess. I hope somebody more in the know will post.
