    Question Dorothy Perkins/Genworth Financial PPI

    I was made redundanticon in October last year so applied for my protection policy to manage my monthly payments for my store card.

    I realised this month that DP were still taking my monthly payments from my bank account.

    I called Genworth Financial who handle the Insurance Claim and asked why payments had not been made (I also have a River Island card also using the protection policy, but payments have been made)

    I was offered no explanation or apology as to why the payments had not been submitted but was told that they would authorise the payments straight away (they had all the relevant info needed from me on my claim form as they are both GE Money and both handled by Genworth)

    I rang Dorothy Perkins this morning explaining that not only had they received the money from me via DD but they had now also received the money from Genworth from my protection policy. I asked if I could have a refund of the monies that I had paid out of my own pocket over the last 3 months. They advised me that I should request a refund through my Bank. Can anyone advise me if this correct and will my bank refund me?

    I don't think you'll get a refund, only because the banks will argue that one of the expressed terms of the insurance was that you were unable to meet the monthly repayments, and you obviously have been able to since October. However, if Genworth have backdated their insurance payout, then I don't see why you are not entitled to a refund for money which the insurance is covering.

    Also, I really do not see the connection with your bank - I think they are saying that if you believe that the DD's have been taken incorrectly, then under the DD guarantee you are entitled to a full and immediate refund from your bank - however, this is only when the guarantee had been breached (i.e. taken on the wrong day, wrong amount, didn't inform you of the amount to be taken beforehand etc) which I don't think applies in this case.

    Thanks for your reply chesham.

    The DD was correct date/amount etc. Genworth have backdated the Insurance as it was obviously their mistake.

    Should I tackle DP again then?

    yes, I would go for DP agin - when I claimed under my PPIicon (and it takes the insurers ages to come up with first payment), it actually said in my letter from the insurers that if I had made payments during the period whilst I was awaiting their payment, then I should contact my lender for refund. However, and this is of course entirely up to you, your debt with DP will clear much quicker if you just leave those "double payments" in the account - if you get them refunded the amount owing will increase & so will your interesticon charges. But, like so many of us, you may be desperate for the cash! t's not really anything to do with the bank, they only followed your instructions in paying the DD - best to cancel DD's if you are claiming PPI

    Good morning Ladybird!

    I did contemplate leaving it in, but after the interesticon charges on there it would only amount to roughly £10 being paid off!! The insurance is paying at £154 per month which is 4 times the amount I was paying.

    I will tackle DP again, if I don't get any joy (their call centre is abroad too ) I will have to write to them.

    I could do with the money on IS at the mo.

    I have never seen this on any redundancyicon insurance I have.

    If you are made redundant and meet the other requirements of the claim (signing on, etc.) then you are entitled to the money whether ir not you can afford to pay for yourself.

    What next? car insuranceicon not paying out on the grounds that you can afford to pay for the repairs yourself?

    Sorry just read chesham's reply again.

    Thank you. I am not sure if my OP was clear or not? This is PPIicon which I have claimed against because of redundancyicon. I have other PPI's which are all paying out including one for River Island (also handled by Genworth Financial). Payments for this account have been made - no problem. The DP account hasn't but when I called them, they siad they would authorise payments straight away. They have now made the payment to my DP account, so what I want to do is claim back my money I had made through my DD. The only reason I could afford to do this is that it had come out of my small redundancy payment.

    I will call DP again and see if I can get anywhere!!

    I'm simply putting forward an argument which the bank may present - I'm not saying they will and I'm not saying it's correct, but surely everyone has learnt that banks will fight to the bitter end?

    Hi Chesham. This,I'm sure is not anything to do with the bank (for once!) The bank was instructed to pay a DD and they did. Therefore Dorothy Perkins have had some of the monthly payments twice. They know PPIicon is in effect on the account, and it is they who should refund the payments, not the bank.

    Don't worry, my OP wasn't the clearest of postings!!!! I appreciate everyone's time and advice. I don't think I will call them, it was bad enough trying to talk to them, so I will write to them and see what happens!!!

    Better to write anyway, then you have a clear record of who said what. I really believe you should get your own payments refunded - make sure they actually refund you if you want the money, rather than allowing them to just credit your account.

    Hi

    This should be quite straightforward to sort out. Write to your bank setting out the case as you have done here.

    Explain that DP say they are liable and ask them to confirm this. If they say they are not then write to DP copying banks letter to them and asking for refund, give them 14 days to respond. If they agree they are ask the Bank to refund you the money. It does seem thought that DP have been paid twice and that they should refund you!

    Do it in writing sent recorded or deliver the letter to the Bank yourself!
