Hi.Can any one help
Iv just spoken to A & L and they were
not very co operative in giving me any information, all they would say is that they had instructed there solicetors to go to court to take a charge on the property. This was for an un secured loan of £15 000 and I was paying £25 per month for 6 months.

I had problems with A&L and still am really. We were paying them a reduced amount on a £15000 loan also direct to Global, we didn't miss payments but they said they were taking me to court to get more money. I attended court and the judge suspended it for 6months to see if my circumstances changed, they didn't attend court.
After six months I contacted them to tell them my financial situation hadn't changed and could we make another arrangement, they refused to talk to me and said that they had instructed solicitors to get a charging order on the property. I attended court and once again they didn't attend, the judge wasn;t too pleases about it and threw it out because they couldn't be bothered to turn up.
Im now living with my parents and had a small amount of equity from the sale of my house. I wanted to try to pay my creditors and after dividing the equity out between them it worked out at 60% of each debt, i would be able to pay. Most of them have accepted this, but A&L will not discusss anything, and have not sent me any corrrespondence at all. What should I do? Is 60% of the full debt, as full & final settlement unreasonable?

Thanks for telling me your story, Im sorry its turned out like that for you, it looks as though this is going to be exactly the same for me They just don't communicate at all. And No 60% under the circumsatnces is not at all unreasonable

I have some interesting information about Global debt management Services Limited....!!!
Will post on here tomorrow. They are not registered with the Information Comissioners Office to process data... this is a very serious offence for them and for A & L.

They have asked me to send them details from the Estate agents regarding the house sale. Which I haven't done.
Iv hava problems with Moorcroft and Global.
Will start doing some inverstigations right now.

If you have been paying £15 a month to Global, send them a CCA (Consumer Credit Areement) request. They have 12 days from (recorded delivery) signature to comply and send it to you or the debt cannot be enforced without them taking you to court. It is highly unlikely that Global will produce this document (they have defaulted on mine) because they are not registered with the IFO. They will probably pass the debt pack to A & L. However, because are not regsitered with the IFO to process data AND they are also not registered with Companies House as trading, this puts them in a very dodgy position if they try and play hardball with you. They would not like these facts to be brought up in court and you can use this info. to your advantage. If you have any proof that you have been making payments to them and that they have received those payments, i.e. bank statements... they are in very serious trouble.
I am waiting for the calendar month to pass after the default on mine... this means that they will also have committed a criminal offence by not supplying the CCA upon request. Once the calendar month is up, they will then get a letter from me demanding a refund of all the monies paid so far (4 years) because they were not legally entitled to collect from me in the first place.... If A & L want to pursue legal action for increased payments/a charge after that, then they run the same risk of me bringing their business activities before a judge.

First sentg CCA as you suggested recorded, but I have checked and its not been delivered/ signed for as yet
In the mean time time Iv received a Court Claim Form from Shoosmith Solicester who say that they are now acting on behalf of Allaince and Leicester to recover the debt of £14881 plus costs. The address on the Court Form under claiment is Globals
Shoosmiths Solicitor on the Claim form ask for all payments and documents to be sent to them, they are based in Nortampton
Secondly I have a letter from Global saying "They write to confirm our arangement as detailed below £25 per month from 30th November 2006 untill 30th January 07 I have paid every month on the 16. The Court Form was done on 2nd Feb. When I rang them on the 16th JAnuary to make a payment Global insisted I pay all the debt when I told them I could'nt but my aggrement was to pay £25 this month they accepted it but refused to discuss the account further but did add they intendf to take a charge on the property.
I don't know what to do next I have till 20th Feb to respond to the Court Claim
Also on the Court Form it asks for details of your Emplolyer do I have to fill this in by Law ?????
I am just beginning to get on top of payments etc and it possibly means I wont have to sell the house now. But this would just about fininish me off
Really need some legal advise can anyone help

This is a very quick reply, 'coz I have to dash out. I would CCA Alliance & Leicester to keep Shoosmiths off your back. Global or A & L Personal Finance (assume it is them ?) can't both have it. Only one co. can provide it. I can almost guarantee that Global won't have it. If you have a letter from Shoosmiths quoting Global as ther client... keep hold of it !! It might be proof that they are trading.
In the meantime, write to Shoosmiths (rec. delivery) reminding them that, as Global have not complied with the CCA request, the account remains in dispute. Shoosmiths are hassling me too at the mo. and I don't think they should be handling your data anyway, as a separate co. from the A & L lot.
Hope this makes sense... I will try and get back on here later if it doesn't.

Hiya Bach... I am dealing with these people at the moment, so that was why my reply was so quick...
I have also been threatened with court action by Shoosmiths, but the debt is in dispute because no-one has complied with my CCA request so far. I also wrote to A & L with a SAR and they have only partly complied, so I have written back asking them for details of when Global became involved, etc. Will see what happens... while they are digging around, the account remains in dispute.
Global actually did sign for my CCA request and cashed the chq., but this may have been a mistake, as they are not meant to be trading. Someone is looking into this for me at the moment and when I find out anything, I will post back on here. This is why I am surprised that Shoosmiths have them down as their clients.
You may want to PM Spotnot about this as she is very interested in dormant, non-trading DCAs. As your info. is different from mine, Global may have just shot themselves in the foot.... time will tell.
Shoosmiths cannot act on behalf of Global because they have not complied with your CCA request. For them to take court action, the CCA would have to be produced and re-enforced through the courts... but I doubt very much if Global have it to produce, but if they do, please let me know immediately if you can.
I would keep your letter to Shoosmiths very short and sweet. Just tell them that you refer to their letter of xx/xx/2007, but would llike to remind them that the above account is currently in dispute, which means that no further action can be taken at this time. Meanwhile, send a CCA to A & L as advised earlier, in order to determine who has the agreement. As I said before, it has to be one or the other... but not both.
While you are waiting for them to comply/default, PM Spotnot describing the details you have on Global. She is investigating non-trading/dormant DCAs and this is what Global are claiming to be.

Had arrangement with Global to pay
£25 00 per month from 30th Nov 06 to 30th Jan 07
letter says to be reviewed at the end of this period.
On 24th January letter from Shoosmiths asking for payment of £14881.29. (can they do this as previous letter said to be revieved after 30th January)
On 2nd Feb received Court forms for Northampton Court. (Shoosmiths)
On 4th February I sent CCA 1974 - section 77-79 request with £1 00 to Global and A & L seperatly. On 11th Feb sent letter to Shoosmith informing them account was in dispute

No unfortuanatly I did'nt I was very nieve , thought because it was in dispute I did'nt have to fill them in. I spoke to the Courts yesterday explaining and also posted a letter of to them explaining the situation. From what I can gather A & L want to take a charge on the property
Don't understand why they are doing this as the property is on the Market, and I wrote and told them that in late October.06
The courts suggested I speke to Shoosmiths,
But rather that telephone Iv sent a letter and a copy of letter sent to the Court.
All I can do now is sit a wait see what happens.
So grateful for your interest and encoragement I think I will post on the Debt Group see if they can come up with any help.
