Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
After our prelimary letter to A & L, they have responded with the standard f*** off letter within 3 days of my posting it. Can I now send the letter before action straight away, or should I wait the stipulated 14 days?
Personally I waited the 14 days as I didnt want them being able to say well you told us we had 14 days but you didnt wait that long. Its frustrating though because you know that is the only response you will get & want to get moving asap. Im currently waiting the 14 days from sending my lba to filing my MCOL... just want to do it now!
HI Sam & Laura
I didnt wait the full 14 days before sending my lba, but i am waiting the full time limit stated in my LBA before filling my MCOL, they have declined to refund you the charges, so crack on..
Thank you both very much for taking the time to respond. Thinking about it, the tone of the letter from A & L was a definate and resounding 'no' so I don't think we have anything to lose by cracking on. As SweetCal says, we know its the only response we are going to get at this stage.
It was just a prelimary 'polite' request after all and they have been very clear in their response so I think it's time to move things on.
As 2hapennys says, once things become a bit more 'official' we will stick to the timelines.
Sam & Laura I would recommend you stick to the timetable, that way no way they can get round it.
Keep going with it you will get all of your money back.
Depending on the bank once the MCOL is logged and they have acknowledged it the money will come soon enough.
I think it ranges from 1 week to 3 weeks or so.
