My advice is to roll the dates forward to avoid the statute of limitations which prevents you from claiming back more than 6 years. You can go back 6 years from the date that the claim is issued in court.
If the account was closed in December, that might be enough to put the claim below £5000 as well.

Thanks for the help, so as long as my claim is just below £5000 not including the 8% interest that will be fine? It works the interest out to about £1100, does this not count within the £5000 limit?

my claim is over £5000, but i am claiming the lot plus the interest, i have been advised to ask for it to go down the fast track route when i get sent the allocations questionaire.
Cases over 5,000.00 cannot go to small claims, and as long as it's under that amount before adding the interest that should be fine. The advantage of small claims, is that the bank can't claim costs if you lose. Bearing in mind that the banks don't go to court though, the danger of this is miniscule so I wouldn't worry if it goes over 5k.
When the Liberals and Conservatives were in opposition they both agreed that banks should pay back high bank charges to customers. Nothing seems to of happened since they came into power as a coalition. PPI insurance has been sorted now they should turn their attention to bank charges and help customers get exorbitant charges refunded.
