    Default My claim is £5159, what to do?

    Right, I have totalled up my clim and it comes to £5159 without including the 8% interesticon.

    I made my claim from November 2000 but added the charges up until they closed my account in December 2006 is this ok?

    I read that you shouldn't really claim for over £5000 through the small claims court, is this including the 8% interest or excluding it?

    I am very grateful for any help as I am waiting to send my claim off.

    My advice is to roll the dates forward to avoid the statute of limitationsicon which prevents you from claiming back more than 6 years. You can go back 6 years from the date that the claim is issued in court.
    If the account was closed in December, that might be enough to put the claim below £5000 as well.

    Hello again,

    Thanks for the help, so as long as my claim is just below £5000 not including the 8% interesticon that will be fine? It works the interest out to about £1100, does this not count within the £5000 limit?

    my claim is over £5000, but i am claiming the lot plus the interesticon, i have been advised to ask for it to go down the fast track route when i get sent the allocations questionaire.

    Its all yours you should try to get it back.

    Cases over 5,000.00 cannot go to small claims, and as long as it's under that amount before adding the interesticon that should be fine. The advantage of small claims, is that the bank can't claim costs if you lose. Bearing in mind that the banks don't go to court though, the danger of this is miniscule so I wouldn't worry if it goes over 5k.
