    Default Settled, but still no money & court tomorrow

    Barclaysicon called Friday evening and offered settlement which I got via email that evening, signed it and faxed back Saturday AM.
    However, slight problem. Court case is tomorrow (Tuesday) and still no money in the account.

    Said money would be in today, however, no money, and court case is Tuesday 23/01/07 @11.15Hrs. Emailed her today, faxed and called and left message, still no money, and no response.

    What should I do?

    Check your account in the morning. If still nothing there you have to attend court. Tell the jusge that although you believed the case to be settled the defendant has still not paid. Take along copies of what you have sent them in regard to accepting thier offer. The Judge will probably adjorn the hearing to see what they do.

    Did you make it a condition of settlement that they pay you in any particular time frame?

    Assuming the money isn't there in the morning, I would attend court and inform them they have made an acceptable offer but you haven't received cleared funds, maybe ask the court for an order instructing them to pay up within 14 days.

    I wouldn't expect the money from the claims i have read about being settled at this late stage.

    Hi, Sorry forgot to up date this one. Got a phone callicon at 8.36 this morning explaining payment had been requested. I said money had to be in account b4 10.00am either I'd be leaving for court. I checked at 09.45 and it was there. all setteled.

    I phoned a faxed the court notification!
