Written by John Kruse, one of the leading experts on Bailiff Law, this consumer friendly guide is essential reading for anyone who comes into contact with a bailiff.
The book is easy to understand and clearly explains the rights
a bailiff has, and also what they cannot do when collecting debts and repossessing goods etc.
I am hoping someone out there can help me. I recently received a pcn for parking in a residents parking bay that was suspended. I am a resident myself and have a valid permit. I will concede that I should not have parked in the suspended bay, but I did not think the restrictions came into effect until 9am, when in fact they came into force at midnight.
At 7.20am, the Council issued a PCN and then immediately towed away my car. Total cost to get it back: £135. I have appealed, but this has been rejected.
Does anyone have experience of appealing against being towed away or picking holes in the Notice of Rejection? I think the actions of the Council were incredibly excessive - at 7.20am, I was not causing an obstruction to anybody, and I would have moved my car by 8am in any event when I left for work.
I was just reading your post on the forum about having your car towed away a couple of years ago.
I know it was a long time ago but was wondering if you had any luck with an appeal against your claim??
Just yesterday I had my car clamped outside my house and there were restrictions on my residence bay. For once they did not notify the residence by post, phone or in person, neither did they give the residence any significant notice (probably about 24 hours and I believe by law it should be 14 days)!
This morning I had woke up to take photos as evidence of the signs and, they had removed the ones that were previously up there the night before and replaced them with new signs for a different part of the street (ie restricted from number 23 to 26 on the xxth April). This is proof that they DO NOT give any form of notice!
It was only when a neighbor knocked on our to tell us our car was towed away that we knew. If she had not of witness this then we would not have known until the weekend as we don’t use our car in the week. This would of encountered an extra £50 per day charge amounting to over £500!
The council should not be allowed to do this and it should be against the law exploit the public in this way!
You've made three posts today - your total since joining the forum - that are virtually identical on three different threads (only one of which is yours and the others resurrected from ages ago).
This is called spamming and will not get you the help you require.
