I have 3 claims to make, 2 of which are against the RBS for and behalf of my son and daughter. My daughter has an agreed £400 overdraft limit and went over tht by 5p. She promptly received a charge of £28.00.

 

The thing is that she is already paying interest for the privelage of having an overdraft and thats OK with me but I strongly resent the £28.00 charge and have written a letter to the bank using the basic legal premises of unlawful penalty etc.

 

My question is this;

 

Can the bank legally charge the £28.00 ?? or is this deemed as unfair which is what I put in the letter? ie Disproportiante charges etc.............???

 

They have since tried to discuss this over the phone but I advised her not to get into any discussions, either pay up or give an answer in writing.

 

Your views would be most welcome.
