    Default No win no fee

    My girlfriend had an accident on a bus and is now suffering from whiplash, her parents have told her to claim on a no win no fee claim with bartlett and sons solicitors.

    I am always wary of these situations and wondered if anyone has any advice, should she go for the claim or not...

    Maybe it's being paranoid about no win no fees, i always believe that someone has to pay...

    Any help would be greatly appreciated.

    If she does go through with a no win no fee, make sure you/she reads the small print of the contract you sign upto with the solicitors. Ensure that there is no loan agreement to sign upt to in regards to covering the costs of the solicitor. Also ensure that what you get at the end is the full amount of the settlement, and that the solicitors will take up their costs with the other party.

    I unfortunately went the oposite way and out of a settlement for £6k I ended up with £3900, as they took their costs from my compensation, with the proviso that they claimed the rest back from the opposite side, and would then pay me the remainder of the money. 2 years later i had heard nothing and they advised that they had not come to an agreement with the other side, but would offer me a good will gesture of £450, I had to accept as I needed the money for fees with my new house.

    No win no fee are great, but check the contract first, THOROUGHLY.

    GE Money S.A.R - (Subject Access Request) issued 21/11/06. Responded 01/12/06. Prelim sent 05/12/06 £406. Response 12/12/06- **SETTLED IN FULL** (£396)
    HSBC S.A.R - (Subject Access Request) issued 05/12/06. NO charges in last 6 years.
    Lowell CCA issued 21/11/06. Further reminder sent 8/12/06. Now commited criminal offence no response.
    Capital One S.A.R - (Subject Access Request) sent 08/12/06 Responded 03/01/07-Prelim Sent 16/01/07. LBA issued 06/02/07- N1 served 07/03/07- acknowledged 14/03/07.
    Scotcall CCA issued 16/01/07. Criminal offence committed.
    HFC Prelim sent 16/01/07. LBA sent- Final Correspondance issued with time limit of 29/03/07.

    I absolutely agree with this.

    "No win, no fee" deals are fine as a last resort. But always remember the old saying "There ain't no such thing as a free lunch"!! 'Someone' always ends up paying! Make sure it isn't your girlfriend!

    It could be worth checking the household insuranceicon policy at wherever she lives. Some cover legal fees for eventualities such as this and could well be a better bet than a "No win, no fee" arrangement.

    Is she a member of a trade union? If so they could probably put her in touch with their own solicitors for a claim as well.
