1st Letter sent 12th January, received reply today 19th January saying they are considering refunding charges, letter is from Sandy Watts and dated 15th January
I am about to get my letter together to send to RBS. It's only for the last 2 months where we have had charges but am annoyed at the amount thay have charged us. £124.00 in total.
Where did you post your letter to? Haven't managed to track their address down yet.
Good Luck by the way. I am in the process of a much larger claim with Barclays which is hopefully coming to an end now after months of fighting.

standard reply dexyblue another letter in 3 or 4 days probibly saying no they won,t depending on how much you are claiming, then send your lba on the 28th January.

so I would send your letter there, my total is the same as yours so fingers crossed, because as I am on benefits I need this refund to pay the D/D they havn't paid even though my money went in the account on the same day, they swiped it all for charges. Did this earlier last year put money in on same day as D/D came out and they paid it then. What also annoys me about RBS they dont send any letters to notify of charges etc.

Not a problem! Hope it helps. The other thing you could do is open what CAG call a parachute account. Open an account elsewhere, have your benefits paid in there, send your prelim off, send them another letter confirming that the account is in dispute. I believe that this means they have to stop charging you until your complaint is resolved.
Result, received a letter from RBOS today refunding my charges, but to accept this they say that any charges that properly accrue in the future will be applied to my account in line with the published tariff and in accordance with my agreement with the bank, should I be unwilling to accept any such charges, then they may need to consider if they are prepared to continue to provide me with my existing banking facilities. Instead they may offer me a simple account that does not offer borrowing facilities or other services that can result in charges. 1) This account is their basic account and my dispute with them was that they had charged me £38 for non payment of d/d even though the money had been put in the bank the same day. 2) I have proof that this happened on another occasion but they honoured the d/d can they pick and choose whether they pay or not? 3) Three times this has happened but like a fool I dont check my statements, it is only when I received a letter asking why the d/d's had not been paid that I realised what had happened.
I remember reading something from the bank about payments and debits.
If you have a DD or SO coming out, it comes off the account in the morning.
If you pay in it isn't reconciled to the account until close of business.
If I've told them on the day of DD that cash is coming into the account that day, they will normally allow the DD to go out, however I've never noticed whether this has directly led to a penalty charge.
But as far as I can see they certainly pick and choose what to pay. For example, I have had DD bounced that would have taken me £5 overlimit, but they always make sure the mortgage payment TO THEMSELVES (mortage with RBS) goes out REGARDLESS of how overdrawn it makes me - my limit is £1000, but once, due to unemployment and no income, they allowed the mortgage to come out putting us at £250 over that.....

He is correct with the payment thing - I used to get stung by this all the time and I asked for an explanation of this. DDs and SOs get bounced first thing in the morning. If you then go into a branch to pay in money or transfer it over the internet, the branch won't see on the screen they are on that anything is amiss.
AS a result, you have to inform the branch that this money is covering a DD or SO and can they ensure that it is honoured. They will then go in to another screen and force the DD / SO through.
Pretty lame imo but there you go.
If your account is the basic account then they can't lower your account to another one! They could however CLOSE your account without further notice.
I'd go with what Hydra said - go somewhere else. FWIW Alliance & Leicester's current account pays around 5-6% interest ATM, can't remember exactly.......

Impressive timescale DB. I got a letter from Sandy Watt (although 'pp' signed) dated the 16th Jan, and still haven't heard anything. Sent my lba on the 26th.
Can I ask, how much did you claim? There doesn't appear to be any sort of precedent at all as to what claims are seen to first...
