    Default A little advice appreciated

    I have been helping some of my family and friends with their charges over the last year.

    With one friend, we sent the lbaicon back on the 2nd June 2006. Since that date, she has not been able to afford the money to take it to MCOL (£120). She is now in a position to pay this so my query is:

    Should we...

    (a) start the whole process again - bearing in mind that a number of charges have since been added to the account

    or

    (b) continue with the previous process, sending another LBA with revised charges, putting in the LBA that we are now in a position to move forward via the courts, and giving them seven days before we proceed with court action.

    Any help much appreciated as, like most people on this forum, she is desperate to get back the funds.

    I would initiate the MCOL for the revised total without delay. In my opinion another lbaicon would only delay things further. They are not going to settle prior to legal claim for a significant amount.

    My advice has hardly any legal foundation whatsoever, however you never know it it might just work!
