    Default Return of school trip deposit money

    I recently paid a 50 pound deposit for my child to go on a school trip to france in july 2007.

    However due to a close family weddingicon my child now is unable to go.

    I have wrote to the school requesting my deposit back.

    The school has stated that the money has been forwarded to the holidayicon company and that the deposit is non-refundable.

    Can I take this matter any further?

    The deposit has always been non-refundable on the overseas school trips my children have done.

    Do you still have a copy of the letter that was sent by the school requesting the deposit?

    The school can withhold money to cover their costs, however they should also mitigate their losses. If they happen to get another child to go in your child's place and that child pays in full, their losses would be zero and you should get the money back. However if they cannot fill that booking, the school will more than likely have to pay the holidayicon company reasonable damages, which you will have to cover as it is you that is in breach of contract and not the school.
