Step3... no reply from the prelim letter after 14 days, so we sent the lbaicon letter on 26th March, just got a reply today 5th April..... 'blah blah bank charges are fair....' yeah right!!
So I wait for the 14 day deadline and then take them to court, right?

Hi all, sent mcol and the claim wass issued on 8th May.. we got a letter from A&L today quoting the recent OFT review and offering partial settlement of £704.00 (including £120.00 court fee) ... a bit short of the £3300 we are claiming for. On the same day we also recieved a letter from solicitors acting on behalf of A&L, giving notice of their intention to defend the claim ???? whats all that about then....

Gotta say getting a bit nervous now, any advice would be greatly appreciated.... I've sent copies of the schedule of charges to the court and I'm going to do the same to Wragge & Co... its very tempting just to bank A&L's cheque....and move on

Of course it's your choice, guys, but you've come so far, it would be a shame if you didn't feel you could go the final sprint.

I think you should hold out and achieve what you deserve.

Each charge should only be around £4.00, so they have overcharged you!!

    Be brave!

Hi All, got the usual 6 page defence back from wragge & co. banging on about insufficient particulars of claim... we've sent the schedule of charges to wragge & co. and the northampton court, today we recieved notice of transfer of proceedings to our local court in sheffield... what do we do next?? Do i need to contact the court?? seems everyone is in a similar position, any advice appreciated.

it was very easy, i phoned them, they asked me a few questions over the phone, like dates of letters etc, they sent me a form to fill in and sign which i did straight away, they sent me a letter saying it was being dealt with and about 4 wks later i received a letter from them saying that although a&l didnt accept that their charges were unfair they were going to pay up anyway, also they are paying about £500 more than my claim! it seems to be the amount the contractual interesticon would have been if i had claimed that. ring the Ombudsmanicon, it may be different for you as you have aleady started court proceedings, but i found them very helpful, and its free, also it stated on their guidelines that if i wasnt happy with the outcome from them i could still go ahead with the courts, youve got nothing to lose, keep me posted and good luck

Hello. I am new to this site and am not too sure how it works yet. But I decided to join as I am now at the Court stage with A+L and am Soooo scared!
Siandnics case seems to be very similar to mine. Started with my claim of £1757 plus interesticon in February (which was less the refunds that I found had been allocated to the account) They eventually wrote disagreeing to any refund at all. I pushed on using the template letters from Money Expert.com. I wont go into the details now, but eventually they offered £779 which included the £120 court fee. I was so angry at the way they have treated me, I refused it and started court proceedings for the total amount of £2432.74 being the charges to my account with interest, and ignored the refunds. Much to my dissappoinment they sent in their defence. Then the courts sent me a letter saying if I didnt pay an extra £100 my case would be struck out. I borrowed the money to pay this, and now it has been allocated to Redditch Aug 16th.
I am not sure what to do now. Only that I am very nervous, and scared that I made the wrong decision in ignoring the refunds to the account when claiming.
    Please HELP
