    Default louloujs v BOS

    Right... I'm on Moneyclaim online, I am going to do two claims - both for BOSicon but separate accounts (which total more than £5000 hence...) and have a minor problem with the online form.

    I know that net of interesticon i can claim up to £5000 to keep within Small Claims track. Just underneath the POCicon, the Amount Claimed asks you to include interest which then takes me over the 5k and requires the £250 court fee.

    Should I just exclude the interest element in the Amount Claimed and leave it to the court to award it (presumptious moi?) in which case do I need to delete any of the Particulars?

    Thanks for any advice.

    interesticon, if claimed at the standard 8% rate, does not affect the track of a case, but will affect the cost - as you have highlighted.

    Unless you really cannot afford the initial fee for court action I would urge you not to withdraw the interest. Merely not referring to it will not help you.

    There is nothing to be overly concerned about regarding fast track. There are potential costs for losers in these cases, but since the banks have never been prepared to fight the battle IN court, the chances of you having to defend and then losing are slim (although of course that doesn't mean we can be complacent).
