Help!! Statements Are Missing but need to send Court Bundle.
I am in the middle of a claim and have to submit my court bundle by 1 March. I wanted to sent it out as soon as possible but having had a really good search through my papers I have found that the statements sent to me by the bank have gone missing.
I have wrote another letter to Lloyds TSB Car Services to ask that they post me more statements though I did not think it would be wrong in saying that they would almost certainly dilly-dally.
Can I send a court bundle without the statements and schedule of charges? Attached my Particulars of Claim,when I first made the claim, was a schedule of charges though I cannot re-send this as well though I this was sent do I need to worry about the statements?
Would anyone know what my options are? Is it worth writing to the court to request a stay? Please help!
Thanks Karnevil. I have already written out for the statements on the Data Protection Act. Was possibly thinking that I could get away with not using the statements in that the bank in their defence recognised that the charges debited but I suppose the statement are evidence.
I will ask the court for the schedule.
Can't believe this is happened as I really thought I had everything in order. I thought it better to make three claims all in one go as I thought I could manage it better.
Let's hope I get these statements on time. I can't check the internet for my credit card statements, only on my current account. Poo.
