I've just registered and am planning on starting the process of recovering charges from our (ex) bank.
I've read through the FAQ and will be browsing through the forums lots more over the next few days. Looks to be loads of great information ! just a couple of quick q's. we have been charged lots of fees, mostly due going slightly over our OD limit , going back years . Is there any specific time period within which we can claim? How far back can we go when adding up charges?
Also we also had a loan with our bank, but were unable to keep up the payments for various and complicated reasons. we have since entered into a debt management plan with the CCC and pay reduced monthly ammounts. Will this have any bearing on our claim at all? Is there any way they could use this against us?

The fact that you are under a re-payment program for a loan with the same bank which you wish to make a claim against won't make any difference to that arrangement. I am in the same position with Abbey, nothing has changed as far as the repayment schedule goes although we are already defaulted for that loan so there isn't much else they can do! lol
Anyway, you can claim up to 6 years back (this date starts from the moment you post your SAR, so 6 years back from then...ok?)
As for claiming back further than that, yes you can I think a few people are doing it but what you have to do is prove to the Judge that you believe that the bank had 'concealed' the fact that the charges were unlawful therefore you couldn't have been expected to know.......if you are going to go down this road then you need to do a lot of serious reading and be sure that it's worth it to you.
You need to post a thread in the relevant bank's section of the forum and keep it up to date so that if you do need help then people are informed as to what stage you are at.
