    Default Do I really want to do this?

    I have received my Bank Statements (they missed the 40 days by 1, but I'll forgive them due to Christmas), I now need some advice please:

    1. Do I include the interest they charged for using the overdrafticon facility?
    2. Do I include the o/draft charges which as previous Girobank customers seem to have spotted varies from £5 to £25 each month?
    3. Do I calculate the 8% interest now before asking A & L to reimburse or wait until it goes to court?

    Any help would be gratefully received.

    Hi there yes include the interesticon they have charged you.
    there is a good interest calculation spreadsheet in templates
    Include all charges, i claimed for charges as little as £3.50 and recived payment in full.
    Do not calculate the 8% untill you are at the court stage

    1. Do I include the interest they charged for using the overdrafticon facility?
    You cannot claim all overdraft interest.


    There are 2 instances of interest you can claim:

    1.When you go overdrawn the bank will charge you interest, perfectly lawfully.

    However, if part of your overdraft is made up of penalty fees, they are also charging you interest on these too and it is this interest which you are entitled to claim back, but it's tricky to separate out from the total interest figure.

    Vampiress has a spreadsheet, (the advanced one), in the bank templates libraryicon, which attempts to calculate this

    It's quite complex and unless your claim is large may not amount to that much, so for simplicity's sake, some people don't bother

    This is the interest referred to in the preliminary and lbaicon letters.

    2. Section 69 8% interest on your claim, but only hen you submit a claim at court. Don't add this interest before moneyclaim

    Well I sent off my lst letter telling them I wanted £3,222 back in unlawful charges on the 15th (Monday) and I had a reply waiting for me today (Thursday)

    "I have now had an opportunity to review why the charges were raised and have also considered your comments. I can confirm that the charges have been applied correctly in line with the terms and conditionsicon of your account, and as such, I regret I am unable to agree a refund on this occasion.

    ... please be assured our charges are in line with those made by other financial organisations."

    Has everyone else had the same letter, mine does not mention credit card charges?

    Am I right in thinking that it is the court warning letter next?

    Just a quick note, you SHOULD be claiming interesticon right from the start, they've taken it from you, you're entitled to it back.

    Charge them at their own "unauthorised" rate, 17.9%

    It'll make a h*ll of a difference if any of the charges are more than a couple of years old
