Help - Egg Card unlawful charges converted to Egg loan
When my business went bust I stupidly let Egg convert my credit card balance into a loan and signed an agreement to boot. Can I dispute the loan on the basis that a large part of is composed of unlawful credit card charges? Can I still SAR them to produce credit card details to support the illegitimacy of the loan? Thanks.

Yes you can SAR them regardless of any situation this is your right.
If it can be clearly shown that this loan was given to address penalty charges,then you have a case for claiming this loan back,in addition to charges connected with it.
Penalty charges are Unlawful NOT illegal !!

Thanks Martin. One of course should be very careful with terminology in these waters. I will SAR them in that case. They told me to take the loan out and pay the card off to cut out the £30 monthly over limit charges I was incurring - is that what you meant?

Thanks! I SAR'd them a few weeks ago and they sent a lettern giving the impression that they were backing off - hopefully because they deleted the card a/c details when I took the loan out.

Hi further to my letter for a CCA following my card being cancelled the Egg have now written to us offering us our charges back??? I called them today to say I would like this sent to me by a cheque but they have refused saying it has to go onto my account as I have a balance?
Can they do this? I now cannot use the card with the high interest and cannot have access to the money they say I am due? They have NOT supplied the CCA?
