    Default Hillsey v NatWest **SETTLED IN FULL**

    I'm claiming my charges back from Natwesticon. Total of £5,400 with interesticon.

    Received my statements and was truly shocked as to how much they had taken from me.

    I completed the spreadsheet and sent it along with the letter before actionicon - Consumer version -asking for it back letter.

    What will happen now as I feel as if I have prodded a very large beast with a pointed stick!

    Am I going to be put through the mangle?

    No you will be £5400 better off. Did you also post the Prelim letter first prior to the L.B.A.

    Question NatWest v Hillsey

    Hello all.

    Sent a claim to Natwesticon on September 16th for £4,439.42 plus £991.57 interesticon for 6 yearsicon charges.

    Got a letter today noting my dissatisfaction but differing in the views expressed in my letter. Despite this they have offered to refund £1,640 as "a gesture of goodwillicon" in Full and finalicon settlement.

    Part of me regards this as a victory but my instinct is to say thanks but no thanks. How do I proceed from here? If I reject this offer do I risk having the offer taken away?

    Any advice would be appreciated.

    Accept this offer as an intrim payment but make it clear that you will persue the rest of your money.
    They may well withdraw the offer but don't worry, carry on using the tried and tested method as used on this forum and you will get ALL your money back.

    Interesting I am at the last stage of my campagn and I have never had an offer at all.

    I'm confused that the letter before actionicon letter looks the same as the first letter that I sent, taken from the templates libraryicon.

    Is there a template for a follow up letter rejecting their offer?

    Had a call this afternoon telling me that my claim has now been referred to the Customer Relations Department. Is this standard practice or should I be worried?

    Bog standard indeed. Good fun to come.

    Very interesting that they seem to have completely changed tactics: they are now making offers right at the beginning of the process rather than completely refusing to pay them at all.

    As my claim is for £5,430.99 is this going to be a Small Claims Court action I will need to embark upon or county courticon? Am I right in thinking there is an £5k limit for Small Claims?

    Also I checked my account today and they have slapped a further £260 in charges in September alone!

    Do I include this in my current claim or start a new one?

    Sorry to ask basic questions but I am new to all of this

    Just got the standard bog off letter from Mr Higley in which he claims the OFT have misled us all on bank charges their ruling only applies to credit cards. Interestingly he has not withdrawn the offer of £1,640 but he hgas stated that there is no more on offer.

    My claim now stands at £5,700 so I am going to proceed.

    Is it now time for the letter before actionicon? If so do I send it to him as he says any proceedings are to be served on his registered office.

    Can somebody help me now as this is definatley "squeaky bum time" for me.

    Yes its time for lbaicon, what i would do is add that you will accept the offer of £1,640 as an interim offer but you will pursue the rest in court!
    do not signicon anything saying Full and finalicon settlement or you wont be able to claim again.
    If they give you the offer then that will bring down your claim amount to below £5,000 so you can go through small claims, pm me if you need further guidance

    Hi Hillsey,

    Sounds and tastes like a very standard response. Go straight to MCOL or N1. Whatever you feel more comfortable with. Make sure you use the right Particulars of Claim as Cobbetts are using it as a new trick to get claims struck out. Go through the site and use the more precise one... Try a winning thread...
